TRAINING REIMBURSEMENT AGREEMENT

This Training Reimbursement Agreement ('Agreement') is made and entered into on this {{date_of_agreement}} by and between:

{{company_name}}, a company duly incorporated under the laws of [African Country, e.g., South Africa], with its principal place of business at {{company_address}} (hereinafter referred to as 'the Company'); and

{{employee_name}}, an individual residing at {{employee_address}}, holding National ID/Passport number {{employee_id_number}} (hereinafter referred to as 'the Employee').

1. Purpose of Agreement

The Company is committed to the professional development of its employees. To this end, the Company agrees to provide financial assistance for specific training or education programs. This Agreement sets forth the terms and conditions under which such assistance is provided and the Employee’s corresponding obligations.

2. Training Program Details

2.1. The Employee shall attend the following training/education program ('the Training Program'):

2.2. The Company agrees to cover the following expenses related to the Training Program:

Course Materials: {{currency}} {{course_materials_cost}}

Travel/Accommodation (if applicable): {{currency}} {{travel_accommodation_cost}}

Other Agreed Expenses: {{currency}} {{other_expenses_cost}}

Total Company Contribution: {{currency}} {{company_contribution_total}}

3. Employee Obligation and Reimbursement

3.1. In consideration of the Company's financial contribution to the Training Program, the Employee agrees to remain in the employment of the Company for a minimum period of {{service_period_months}} months ('Service Period') commencing from the completion date of the Training Program ({{training_completion_date}}).

3.2. If the Employee voluntarily terminates their employment with the Company or their employment is terminated for cause by the Company prior to the expiry of the Service Period, the Employee shall be liable to reimburse the Company for the full or a pro-rata portion of the Company's contribution to the Training Program, as follows:

a) If termination occurs within {{reimbursement_period_1_months}} months of completion: {{reimbursement_percentage_1}}% of the total Company Contribution.

b) If termination occurs between {{reimbursement_period_1_months}} and {{reimbursement_period_2_months}} months of completion: {{reimbursement_percentage_2}}% of the total Company Contribution.

c) If termination occurs between {{reimbursement_period_2_months}} and {{service_period_months}} months of completion: {{reimbursement_percentage_3}}% of the total Company Contribution.

3.3. The reimbursement amount shall be deducted from any final payments due to the Employee, including but not limited to, salary, leave pay, and provident/pension fund payouts, to the extent permitted by law. Should the final payments be insufficient to cover the reimbursement amount, the Employee agrees to repay the outstanding balance within {{repayment_days}} days of the termination date.

4. Exceptions to Reimbursement

The reimbursement obligation shall not apply if:

a) The Employee's employment is terminated by the Company due to retrenchment or redundancy.

b) The Employee's employment is terminated by the Company without cause.

c) The Employee is unable to complete the Training Program or fulfil the Service Period due to certified long-term illness, disability, or death.

5. Acknowledgment and Agreement

The Employee acknowledges that they have read and understood the terms and conditions of this Agreement and agree to be bound by them. The Employee further acknowledges that the financial assistance provided by the Company for the Training Program is a direct benefit contingent upon their continued service.

6. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of [African Country, e.g., the Republic of South Africa]. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of [African Country, e.g., South Africa].

7. Entire Agreement

This Agreement constitutes the entire agreement between the Company and the Employee with respect to the subject matter hereof and supersedes all prior discussions, negotiations, and agreements, whether oral or written.
