Terms of Service

The agreement between you and MyBizBox when you use our platform.

1. Who we are (Legal Entity)

The MyBizBox platform is owned and operated by VIPAC Plant and Machinery (Pty) Ltd, a company registered in the Republic of South Africa ("MyBizBox", "we", "us"). All services offered under the MyBizBox™ name — including the mobile apps, web platform, AI assistant, and WhatsApp Business integration — are provided by VIPAC Plant and Machinery (Pty) Ltd.

We provide a mobile-first, WhatsApp-first Business Operating System for African SMEs. These Terms of Service ("Terms") govern your use of our websites, mobile apps, WhatsApp integrations, APIs, and any related services (together, the "Services").

By creating an account, connecting a WhatsApp Business Account, or otherwise using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

2. Accounts and eligibility

  • You must be at least 18 years old and legally able to enter a binding contract.
  • You are responsible for all activity under your account. Keep your credentials secure.
  • You must give accurate business information and update it if it changes.
  • You may not create an account on behalf of a business without authority to bind it.

3. Subscriptions and payment

  • Some Services are free. Paid plans are billed monthly or annually and renew automatically until cancelled.
  • All prices are shown in ZAR (or your local currency where available) and exclude VAT unless stated.
  • Cancellations take effect at the end of the current billing period. No pro-rated refunds unless required by law.
  • We may change pricing on notice; changes apply to the next renewal, not the current period.
  • Payment is processed by third-party payment providers (Paystack, Peach Payments, PayFast, Stripe). Their terms also apply.

4. WhatsApp Business, Meta, and messaging fees

MyBizBox integrates with the WhatsApp Business Platform. If you connect your own WhatsApp Business Account ("WABA") to MyBizBox through Meta's Embedded Signup, you agree to:

  • Meta's WhatsApp Business Terms, Meta Platform Terms, and applicable Commerce & Messaging policies.
  • Meta's per-conversation messaging fees, which are billed to your WABA by Meta (not MyBizBox) unless we explicitly agree otherwise in writing.
  • Sending only messages permitted by WhatsApp policy — no spam, no unsolicited marketing to unopted-in recipients, and no restricted content.
  • Complying with any template approval requirements for outbound messages.

We act as a Business Solution Provider surface for your own WABA — you remain the sender and the data controller for messages you send.

5. Acceptable use

You will not:

  • Break any law, or use the Services to defraud, harass, defame, or infringe another person or business.
  • Send spam, phishing, malware, or unsolicited bulk messages via WhatsApp, email, or SMS.
  • Reverse engineer, scrape, or attempt to bypass our security, rate limits, or usage controls.
  • Resell, sub-license, or white-label the Services without our written consent.
  • Impersonate MyBizBox, Meta, WhatsApp, or any other person or business.
  • Upload content you do not have the right to use.

We may suspend or terminate accounts that violate these rules or endanger our platform, our users, or the WhatsApp Business ecosystem.

6. Your content and data

  • You own the content you upload, generate, or send through the Services.
  • You grant us a limited licence to host, process, and transmit that content solely to operate the Services (including AI drafting, backups, and analytics you have enabled).
  • We do not sell your data or your customers' data to advertisers.
  • We do not train shared or public AI models on your confidential documents without your explicit opt-in.
  • How we handle personal data is set out in our Privacy Policy.

7. AI-generated content

The Services include AI features that generate quotes, invoices, letters, policies, summaries, and other content. AI output is a suggestion — you are responsible for reviewing it before sending it to a customer, an employee, or a regulator. MyBizBox does not provide legal, tax, or financial advice.

8. Marketplace and third-party templates

Where third-party vendors sell templates or kits in our marketplace, the vendor is the contracting party for that specific purchase. We facilitate the transaction, collect payment, and provide baseline dispute handling, but we are not the primary seller of vendor content.

9. Availability and support

  • We target 99.5% monthly availability but do not warrant uninterrupted service.
  • We may perform maintenance and will notify you where reasonably practical.
  • Support is provided via in-app chat and support@mybizbox.app.

10. Termination and account deletion

You can cancel your subscription any time in Settings. You can delete your account and all business data:

We may suspend or terminate accounts that materially breach these Terms, the WhatsApp Business Terms, or the law. We will normally give notice, except where an emergency (security, spam, fraud) requires immediate action.

11. Warranties and disclaimers

The Services are provided "as is". To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms limits liability that cannot be limited by law (including under the South African Consumer Protection Act where it applies).

12. Limitation of liability

To the maximum extent permitted by law, MyBizBox will not be liable for indirect, consequential, incidental, or special losses (including lost profits, lost revenue, lost data, or business interruption) arising from your use of the Services. Our aggregate liability for any claim will not exceed the greater of (a) fees you paid to us in the 12 months before the claim, or (b) ZAR 5,000.

13. Indemnity

You will indemnify MyBizBox against claims arising from your content, your use of the Services in violation of these Terms or law, or your breach of the WhatsApp Business Terms.

14. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email or in-app at least 14 days before they take effect. Continuing to use the Services after the effective date means you accept the updated Terms.

15. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. Disputes will be handled in the courts of Cape Town, unless mandatory local consumer protection law of your country of residence gives you a different right.
