Drug Testing Consent Agreement
This Drug Testing Consent Agreement ('Agreement') is made and entered into on this day of {{day}} of {{month}}, {{year}}, by and between {{company_name}} (hereinafter referred to as 'the Company') and {{employee_name}} (hereinafter referred to as 'the Employee').
Purpose of Agreement
The Company is committed to providing a safe, healthy, and productive work environment for all its employees. To achieve this, the Company has established a drug and alcohol-free workplace policy. This Agreement outlines the Employee's consent to undergo drug testing in accordance with the Company's policy and applicable laws.
Consent to Testing
I, {{employee_name}}, hereby voluntarily consent to submit to drug and alcohol testing as required by {{company_name}}'s Drug and Alcohol Policy. I understand that such testing may include, but is not limited to, pre-employment testing, reasonable suspicion testing, post-accident testing, random testing, and return-to-duty testing.
I understand that the testing may involve the collection of urine, blood, hair, or breath samples, as deemed necessary by the Company and in accordance with established medical and legal protocols. I authorize the collection and analysis of such samples by designated medical personnel or certified laboratories.
Confidentiality
I understand that all drug testing results will be treated with strict confidentiality. Access to these records will be limited to authorized Company personnel and medical professionals involved in the administration of the drug testing program, in accordance with privacy laws and company policy.
However, I acknowledge that in certain circumstances, test results may be disclosed to relevant legal authorities if required by law or court order.
Consequences of Refusal or Positive Test
I understand that refusal to consent to drug testing, or failure to cooperate with the testing procedure, may result in disciplinary action, including termination of employment, in accordance with the Company's Disciplinary Code and Drug and Alcohol Policy.
I further understand that a confirmed positive drug test result may also lead to disciplinary action, including but not limited to, referral for substance abuse counselling, suspension, or termination of employment, depending on the severity and nature of the offence, and in line with company policy and relevant labour laws.
Acknowledgement of Policy
I confirm that I have received, read, and understood {{company_name}}'s Drug and Alcohol Policy, and I agree to abide by all its terms and conditions. I have been given the opportunity to ask questions regarding this Agreement and the Company's policy, and all my questions have been answered to my satisfaction.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of {{country_name}}.
