TEXAS LIABILITY WAIVER FORM

ASSUMPTION OF RISK

I, {{participant_name}}, understand and acknowledge that participation in the activity/event, {{activity_name}}, on {{activity_date}} at {{activity_location}} (the "Activity") involves inherent risks, dangers, and hazards that may cause serious injury, including but not limited to, bodily injury, minor or severe physical injuries, illness, disease, trauma, pain and suffering, economic loss, property damage, or death. These risks may result from my own actions or inactions, the actions or inactions of others, or the nature of the Activity itself. I voluntarily assume all risks, both known and unknown, associated with my participation in this Activity.

RELEASE OF LIABILITY

In consideration for being permitted to participate in the Activity, I hereby voluntarily release, waive, discharge, and covenant not to sue the Company, its owners, directors, officers, employees, agents, representatives, affiliates, and volunteers (collectively, the "Releasees") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or any property belonging to me, whether caused by the negligence of the Releasees or otherwise, while participating in the Activity, or while in, on or upon the premises where the Activity is being conducted.

INDEMNIFICATION

I agree to indemnify and hold harmless the Releasees from any loss, liability, damage, or costs, including attorney’s fees, that they may incur due to my participation in the Activity, whether caused by my negligence or otherwise. This includes any claims brought by third parties arising out of my conduct during the Activity.

MEDICAL TREATMENT AUTHORIZATION

In the event of an injury or medical emergency, I authorize the Company to seek and obtain medical treatment on my behalf, including but not limited to, emergency medical services and transportation to a medical facility. I understand that I am responsible for all costs associated with such medical treatment. I represent that I am in good health and have no medical conditions that would prevent me from participating in the Activity. I agree to notify the Company of any pre-existing medical conditions or allergies as specified in {{medical_conditions_disclosure}}.

GOVERNING LAW

This Agreement shall be construed and enforced in accordance with the laws of the State of Texas, without regard to its conflict of laws principles. Any legal action or proceeding relating to this Agreement shall be brought exclusively in the state or federal courts located in the State of Texas.

SEVERABILITY

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

ACKNOWLEDGMENT AND UNDERSTANDING

I have read this Agreement, fully understand its terms, and I understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing this Agreement freely and voluntarily, and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
