Agreement to Arbitrate
The Employee and {{company_name}} (the “Company”) agree that any and all disputes, claims, or controversies arising out of or relating to the Employee’s employment with the Company, including but not limited to claims for wages, discrimination, harassment, wrongful termination, or any other employment-related claims, shall be resolved exclusively by final and binding arbitration.
This agreement to arbitrate applies to all claims, whether brought by the Employee or the Company, and whether based on statute, common law, contract, or tort.
Arbitration Process
The arbitration shall be conducted in accordance with the rules of the Arbitration Foundation of Southern Africa (AFSA) or another mutually agreed-upon arbitration body. The arbitration shall be conducted by a single arbitrator agreed upon by both parties, or if the parties cannot agree, by an arbitrator appointed in accordance with the AFSA rules.
The arbitration shall take place in {{city}}, {{country}}. The parties agree to bear their own legal costs and to equally share the costs of the arbitrator and the arbitration facility, unless otherwise ordered by the arbitrator.
Waiver of Jury Trial and Class Action
By agreeing to this arbitration provision, the Employee and the Company waive their right to a jury trial for any arbitrable claims. Furthermore, the Employee and the Company waive their right to participate in any class action lawsuit or collective arbitration regarding such claims.
Governing Law
This Arbitration Agreement shall be governed by and construed in accordance with the laws of {{country}}, without regard to its conflict of laws principles.
Confidentiality
All aspects of the arbitration process, including the hearing, the award, and any related documents, shall be confidential and shall not be disclosed to any third party, except as required by law.
Severability
If any provision of this Arbitration Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement
This Arbitration Agreement constitutes the entire understanding between the Employee and the Company regarding the resolution of disputes arising out of employment and supersedes all prior agreements, understandings, discussions, and negotiations, whether oral or written.
Acknowledgement
The Employee acknowledges that they have read and understood this Arbitration Agreement, have had the opportunity to consult with legal counsel, and voluntarily agree to its terms.
