MUTUAL TERMINATION OF EMPLOYMENT CONTRACT

This Mutual Termination of Employment Contract ('Agreement') is made and entered into on this {{day}} day of {{month}}, {{year}}, by and between:

{{company_name}}, a company duly incorporated under the laws of {{country}}, with its principal place of business at {{company_address}} (hereinafter referred to as 'the Employer');

AND

{{employee_name}}, an adult individual residing at {{employee_address}}, with Identity Number {{employee_id_number}} (hereinafter referred to as 'the Employee').

Collectively referred to as 'the Parties'.

BACKGROUND

WHEREAS, the Employee is currently employed by the Employer in the position of {{employee_position}} in terms of an employment contract dated {{original_contract_date}} ('the Employment Contract');

AND WHEREAS, the Parties have, for good and valid reasons, mutually agreed to terminate the Employment Contract on the terms and conditions set forth herein.

TERMINATION DATE

The Parties hereby agree that the Employment Contract shall terminate by mutual agreement, effective on {{termination_date}} ('the Termination Date').

FINAL REMUNERATION AND BENEFITS

The Employer shall pay the Employee all outstanding salary, pro-rata leave pay, and any other benefits due up to and including the Termination Date. This will include {{specific_benefits_details}}. The final payment will be made on or before {{final_payment_date}}.

RETURN OF COMPANY PROPERTY

The Employee agrees to return all company property, including but not limited to, laptops, mobile phones, company vehicles, keys, and documents, in good working order to the Employer by {{return_property_date}}.

The Employee acknowledges and agrees to continue to be bound by the confidentiality provisions outlined in the original Employment Contract, ensuring that all confidential information obtained during the course of employment remains confidential indefinitely.

RELEASE AND WAIVER

Upon execution of this Agreement and receipt of all amounts due, the Employee fully and finally releases and discharges the Employer, its directors, employees, and agents from any and all claims, demands, actions, or causes of action whatsoever, whether known or unknown, arising from or relating to the Employee’s employment and the termination thereof.

ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the Parties concerning the mutual termination of the Employment Contract and supersedes all prior discussions, negotiations, and agreements, whether oral or written, between the Parties.

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of {{country}}.
