DRUG TESTING CONSENT AGREEMENT
This Drug Testing Consent Agreement (hereinafter "Agreement") is entered into on this {{date}} day of {{month}}, {{year}}, by and between {{company_name}} (hereinafter "the Company"), and {{employee_name}} (hereinafter "the Employee") with employee ID number {{employee_id}}.
BACKGROUND
The Company is committed to providing a safe, healthy, and productive work environment for all its employees. In furtherance of this commitment and in compliance with applicable laws and regulations, the Company has established a workplace drug testing policy (hereinafter "the Policy"). The Employee acknowledges receipt and understanding of the Company's Drug Testing Policy, which has been made available for review.
CONSENT TO TESTING
The Employee hereby voluntarily consents to undergo drug and alcohol testing as required by the Company's Policy. This consent extends to pre-employment, reasonable suspicion, post-accident, random, and return-to-duty testing.
The Employee understands that drug and alcohol testing may involve taking samples of urine, blood, hair, saliva, or other biological specimens as deemed necessary by the Company or its designated medical professionals.
The Employee authorises any laboratory, medical facility, or healthcare provider designated by the Company to conduct such tests and to release the results directly to the Company's authorised personnel, specifically {{authorised_personnel_title}}.
CONFIDENTIALITY
The Company agrees to maintain the confidentiality of all drug and alcohol test results to the extent required by law. Test results will only be shared with those individuals within the Company who have a legitimate need to know for employment-related decisions or as required by law.
CONSEQUENCES OF REFUSAL OR POSITIVE TEST
The Employee understands that refusal to submit to a drug or alcohol test, or tampering with a sample, will be treated as a positive test result and may lead to disciplinary action, up to and including termination of employment.
A confirmed positive test result for illegal substances or unauthorised alcohol use, or a breach of the Company's policy regarding prescription medication, may also result in disciplinary action, up to and including termination of employment, in accordance with the Company's Policy and applicable labour laws.
EMPLOYEE ACKNOWLEDGEMENT
I, {{employee_name}}, acknowledge that I have read and understand the terms of this Drug Testing Consent Agreement and the Company's Drug Testing Policy. I understand that signing this Agreement is a condition of my employment/continued employment with {{company_name}}. I voluntarily consent to all the terms and conditions outlined herein.
GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of {{country}}.
