EMPLOYEE MATTERS AGREEMENT
This Employee Matters Agreement (hereinafter "Agreement") is made and entered into on this {{day}} day of {{month}}, {{year}}, by and between:
{{company_name}}, a company duly incorporated and existing under the laws of {{country_of_incorporation}}, with its registered office at {{company_address}} (hereinafter "the Employer"); and
{{employee_name}}, an adult individual residing at {{employee_address}}, holding national identification number {{employee_id_number}} (hereinafter "the Employee").
1. Commencement of Employment
The Employee's employment with the Employer shall commence on {{start_date}}.
2. Position and Duties
The Employee shall be employed in the position of {{job_title}}. The Employee shall report to {{reporting_manager}} and shall perform such duties and responsibilities as are ordinarily associated with this position, as well as any other duties lawfully assigned by the Employer from time to time. A detailed job description is attached hereto as Annexure A.
3. Remuneration
The Employee's gross monthly salary shall be {{currency}} {{gross_salary_amount}} ({{gross_salary_amount_words}}) payable in arrears on or before the {{payment_day}} day of each month. In addition to the basic salary, the Employee shall be entitled to such benefits as outlined in the Employer's Staff Handbook or as otherwise agreed in writing, including but not limited to {{benefits_description}}.
4. Working Hours
The Employee's ordinary working hours shall be {{daily_hours}} hours per day, from {{start_time}} to {{end_time}}, Monday to Friday. The Employee acknowledges that they may be required to work overtime from time to time, as dictated by the operational needs of the Employer, in accordance with applicable labour laws.
5. Leave
The Employee shall be entitled to annual leave of {{annual_leave_days}} working days per annum, sick leave as per statutory requirements, and other forms of leave (e.g., family responsibility leave, maternity/paternity leave) in accordance with the Employer's Leave Policy and applicable labour legislation.
6. Confidentiality and Intellectual Property
The Employee acknowledges that during the course of employment, they may gain access to confidential information relating to the Employer's business. The Employee undertakes to keep such information strictly confidential both during and after the termination of employment. All intellectual property created by the Employee in the course of their employment shall vest in the Employer.
7. Termination of Employment
Either party may terminate this Agreement by giving {{notice_period}} written notice to the other party. The Employer reserves the right to terminate employment without notice in instances of serious misconduct, as defined by applicable labour law and the Employer's Disciplinary Code. Upon termination, the Employee shall return all company property.
8. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of {{country}}. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of {{country}}.
9. Entire Agreement
This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior agreements, understandings, and negotiations, whether oral or written.
