Preamble

We, the realtors of {{company_name}}, acknowledge our fundamental responsibility to the public, our clients, and our fellow professionals. Our commitment to ethical conduct is paramount to maintaining the public's trust in the real estate profession. This Code of Ethics serves as a guide for our professional conduct and performance.

Article 1: Duty to Clients

1.1. Realtors shall protect and promote the interests of their client. This obligation of absolute fidelity to the client’s interests is primary.

1.2. Realtors shall treat all parties honestly and shall not knowingly misrepresent facts or make false promises.

1.3. Realtors shall disclose all known material facts pertinent to the property or the transaction to the client and all relevant parties.

1.4. Realtors shall maintain confidentiality of client information entrusted to them, except where disclosure is required by law or judicial order.

Article 2: Duty to the Public

2.1. Realtors shall avoid exaggeration, misrepresentation, or concealment of pertinent facts relating to properties or transactions. They shall not undertake to provide specialized professional services concerning a type of property or service that is outside their field of expertise, unless they engage the assistance of one who is competent on such types of property or service.

2.2. Realtors shall not discriminate in real estate services on the basis of race, colour, religion, sex, handicap, familial status, or national origin.

2.3. Realtors shall ensure that all advertising and marketing materials are truthful and not misleading.

Article 3: Duty to Fellow Realtors

3.1. Realtors shall not engage in any practice or take any action inconsistent with the agency or other exclusive relationship recognised by law that other realtors have with clients.

3.2. Realtors shall cooperate with other brokers except when cooperation is not in the client’s best interest. The obligation to cooperate does not include the obligation to share commissions, fees, or to otherwise compensate another broker.

3.3. Realtors shall not make false or misleading statements about other realtors, their businesses, or their business practices.

Article 4: Professional Competence

4.1. Realtors shall endeavour to assure at all times a high level of competence and integrity in their professional activities.

4.2. Realtors shall keep themselves informed on matters affecting real estate in their community, the country, and the region and shall willingly share the fruit of their experience and study with others.

4.3. Realtors shall be knowledgeable and competent in the areas of practice in which they engage.

Article 5: Handling of Funds

5.1. Realtors shall deposit all funds received on behalf of a client or other person in a separate trust account in a financial institution, designated as such, and not commingle said funds with their own personal funds or those of the company.

5.2. Realtors shall provide accurate and timely accounting for all monies and property received on behalf of clients.

Enforcement and Compliance

Any violation of this Code of Ethics may result in disciplinary action, including but not limited to, formal reprimand, suspension, or termination of employment/association with {{company_name}}. All complaints will be investigated by {{ethics_committee_name}} in accordance with established procedures.
