CO-HABITATION AGREEMENT
This Co-habitation Agreement (the “Agreement”) is made and entered into on this {{day}} day of {{month}}, {{year}}, by and between:
Party A: {{party_a_full_name}}, of identity number {{party_a_id_number}}, residing at {{party_a_address}} (hereinafter referred to as “Party A”); and
Party B: {{party_b_full_name}}, of identity number {{party_b_id_number}}, residing at {{party_b_address}} (hereinafter referred to as “Party B”).
Collectively referred to as “the Parties”.
1. RECITAL
WHEREAS, the Parties intend to cohabit in a committed, unmarried relationship and desire to define their respective rights and responsibilities regarding financial matters, property, and general living arrangements during their cohabitation and in the event of separation.
2. COMMENCEMENT OF COHABITATION
The Parties agree to commence cohabitation at the property located at {{cohabitation_address}} on or about {{cohabitation_start_date}}.
4. SEPARATE PROPERTY
Each Party shall retain full ownership and control over all property owned individually prior to the commencement of this Agreement, as well as any property acquired individually during the cohabitation, which includes, but is not limited to, real estate, bank accounts, investments, vehicles, and personal belongings. Such property shall be considered separate property and not subject to division upon separation.
A schedule of separate property for each Party is attached hereto as Annexure 'A'.
5. JOINT PROPERTY
Any property acquired jointly by the Parties during the cohabitation, with the express written intention of joint ownership, shall be considered joint property. Upon separation, joint property shall be divided equally or as otherwise agreed upon in writing by the Parties at the time of acquisition.
A schedule of joint property is attached hereto as Annexure 'B'.
6. DEBTS AND LIABILITIES
Each Party shall be solely responsible for any debts or liabilities incurred individually prior to or during the cohabitation. Joint debts, if any, shall be explicitly agreed upon in writing by both Parties, outlining the responsibilities for repayment.
Neither Party shall be held responsible for the separate debts of the other Party.
7. TERMINATION OF AGREEMENT AND SEPARATION
This Agreement shall terminate upon the marriage of the Parties, or upon either Party giving {{notice_period}} days’ written notice to the other Party of their intention to terminate the cohabitation.
In the event of termination, the Parties shall endeavour to amicably resolve all matters pertaining to the division of joint property and liabilities. Should an amicable resolution not be reached, the Parties agree to engage in mediation before resorting to legal action.
8. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of {{country_of_governance}}.
9. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the Parties and supersedes all prior discussions, negotiations, and agreements, whether oral or written, relating to the subject matter hereof.
