No-Fault Attendance Policy

**Policy Number:** {{policy_number}}

**Effective Date:** {{effective_date}}

**Revision Date:** {{revision_date}}

1. Purpose

The purpose of this No-Fault Attendance Policy is to establish clear and consistent guidelines for employee attendance, minimize unscheduled absences, and ensure adequate staffing levels to maintain operational efficiency. This policy treats all absences (excluding approved leave) as occurrences, regardless of the reason, thereby promoting fairness and reducing subjective judgments.

2. Scope

This policy applies to all employees of {{company_name}}, regardless of their employment status (full-time, part-time, temporary) or position.

3. Definitions

**Absence:** Failure to report for a scheduled shift.

**Late Arrival:** Reporting for a scheduled shift after the designated start time.

**Early Departure:** Leaving a scheduled shift before the designated end time.

**Occurrence:** Any single instance of absence, late arrival, or early departure. Multiple consecutive days of absence for the same reason will be counted as a single occurrence, provided the employee notifies the company on the first day and provides a medical certificate where applicable.

**Approved Leave:** Leave granted in accordance with company policy and applicable labour laws (e.g., annual leave, sick leave within legal limits, maternity leave, compassionate leave). Approved leave does not count as an occurrence.

4. Attendance Expectations

Employees are expected to attend work reliably and punctually as scheduled. Any absence, late arrival, or early departure must be reported to {{immediate_supervisor_name_or_department}} by {{time_of_notification}} on the day of the occurrence, or as soon as reasonably possible. Failure to provide timely notification may result in additional disciplinary action.

5. Occurrence System

The company utilizes a progressive disciplinary system based on occurrences. Occurrences will be tracked over a rolling {{rolling_period_months}}-month period. The following disciplinary actions will be taken:

* **After {{number_of_occurrences_1}} occurrences:** Verbal Warning

* **After {{number_of_occurrences_2}} occurrences:** Written Warning

* **After {{number_of_occurrences_3}} occurrences:** Final Written Warning

* **After {{number_of_occurrences_4}} occurrences:** Review for Termination of Employment

Each disciplinary level will be accompanied by counseling and an opportunity for the employee to improve their attendance.

Occurrences will expire {{occurrence_expiration_timeframe}} from the date they were recorded.

6. Exemptions (Approved Leave)

The following types of leave, when properly requested and approved in advance or in accordance with company policy and applicable labour laws, will not be counted as occurrences:

* Annual Leave

* Sick Leave (within the statutory limits and with required medical certificates)

* Maternity/Paternity Leave

* Compassionate Leave

* Family Responsibility Leave

* Leave for Military or Jury Duty (where applicable)

* Business Travel or Company-Mandated Training

7. Reporting Absences and Lateness

To report an absence or expected lateness, employees must:

* Contact their immediate supervisor or {{HR_department}} by phone at {{phone_number_for_reporting}} or via email at {{email_for_reporting}}.

* Provide the reason for the absence/lateness and the expected duration.

* If absent due to illness for more than {{number_of_days}} consecutive days, a medical certificate from a registered medical practitioner must be submitted upon return to work.

Failure to follow proper reporting procedures will result in the absence being unexcused and will be counted as an occurrence, potentially leading to further disciplinary action.

8. Return to Work

Upon returning to work after an absence, employees are responsible for ensuring all outstanding work is completed and for catching up on any missed information. For absences due to illness, employees may be required to provide a 'fit for duty' certificate if determined necessary by management.

9. Policy Review and Amendments

This policy will be reviewed on an annual basis or as required by changes in legislation or company operational needs. {{company_name}} reserves the right to amend this policy at its sole discretion, with appropriate notification to employees.

10. Employee Acknowledgment

I, {{employee_name}}, acknowledge that I have received, read, and understood the No-Fault Attendance Policy of {{company_name}}. I agree to adhere to its terms and conditions.
