Non-Profit Gift Acceptance Policy
Non-Profit Gift Acceptance Policy
1. Purpose
The purpose of this Gift Acceptance Policy is to provide guidance to {{non_profit_name}} staff, board members, and volunteers regarding the acceptance of gifts and to ensure that all donations are handled in a manner that aligns with our mission, values, and legal and ethical obligations. This policy aims to protect both the donor and {{non_profit_name}}.
2. Scope
This policy applies to all gifts, contributions, and donations received by {{non_profit_name}}, regardless of their form or value, and covers financial donations, in-kind donations, and planned gifts. It applies to all individuals involved in the solicitation, processing, and acceptance of gifts.
3. Principles of Gift Acceptance
{{non_profit_name}} will accept gifts that are consistent with its mission and that support its programs and activities.
Gifts will be accepted in compliance with all applicable laws and regulations, including those related to charitable giving, tax regulations, and anti-money laundering.
Donors will be treated with respect and confidentiality, and their wishes regarding anonymity will be honored where possible.
{{non_profit_name}} reserves the right to decline any gift that does not align with its mission, values, or that could compromise its integrity or financial stability.
4. Types of Acceptable Gifts
4.1. Cash Contributions: Donations made by cash, cheque, electronic funds transfer (EFT), or credit card.
4.2. Pledges: Written commitments to make a donation over a specified period. All pledges will be documented in writing.
4.3. Securities: Readily marketable securities, such as publicly traded stocks, bonds, and mutual funds. Acceptance of non-publicly traded securities will require prior approval from the Board of Directors.
4.4. Real Estate: Gifts of real estate will be subject to a thorough evaluation process, including an environmental assessment, appraisal, and review by the Board of Directors. All costs associated with the transfer will be borne by the donor.
4.5. Tangible Personal Property: Gifts of tangible personal property will be accepted if they are relevant to {{non_profit_name}}'s mission, can be readily used or disposed of, and do not incur excessive maintenance or storage costs. Examples include equipment, books, and artwork. A fair market value appraisal may be required.
4.6. Planned Gifts: Including bequests, charitable gift annuities, charitable remainder trusts, and life insurance policies. These gifts will be accepted in accordance with specific guidelines developed for planned giving.
5. Gifts Requiring Special Review
The following types of gifts will require review and approval by the Board of Directors or a designated committee before acceptance:
- Gifts with restrictions or conditions attached.
- Gifts that could create a conflict of interest for {{non_profit_name}}.
- Gifts that could expose {{non_profit_name}} to unusual liabilities or financial obligations.
- Gifts that are difficult to value or liquidate.
- Gifts of property that could have environmental risks.
6. Gift Acknowledgment and Receipting
All gifts will be acknowledged promptly in writing. Official tax receipts will be issued in accordance with applicable tax regulations in {{country}}.
Donors will receive a written acknowledgment of their gift, expressing gratitude for their support.
For gifts of property, the donor is responsible for obtaining an appraisal to determine the fair market value, unless otherwise specified by tax regulations.
7. Restricted Gifts
{{non_profit_name}} will generally accept unrestricted gifts, which allow for the greatest flexibility in allocating funds to areas of greatest need.
Restricted gifts, designated for specific programs or projects, will be accepted provided they align with {{non_profit_name}}'s mission and strategic priorities. The Board of Directors must approve all restricted gifts over {{restricted_gift_threshold_amount}}.
If a restricted gift cannot be used for its intended purpose (e.g., due to project completion or changes in needs), {{non_profit_name}} will endeavor to contact the donor to discuss alternative uses. If the donor cannot be reached, the funds may be redirected to a similar program or to the general operating fund with Board approval.
8. Donor Anonymity
{{non_profit_name}} will respect the wishes of donors who request anonymity. Confidentiality will be maintained regarding the identity of anonymous donors and the details of their gifts.
9. Gift Acceptance Committee (Optional)
A Gift Acceptance Committee, comprising members of the Board of Directors and senior staff, may be established to review complex gifts, gifts requiring special approval, and to advise on gift acceptance policies and procedures. The committee will meet as needed and report to the Board of Directors.
10. Policy Review
This Gift Acceptance Policy will be reviewed periodically, at least every {{review_period_years}} years, by the Board of Directors to ensure its continued relevance, effectiveness, and compliance with legal and ethical standards.
