POST-NUPTIAL AGREEMENT

This Post-Nuptial Agreement (hereinafter referred to as the "Agreement") is made and entered into on this {{day}} day of {{month}}, {{year}}, by and between:

{{husband_full_name}} (Identity Number: {{husband_id_number}}), residing at {{husband_address}} (hereinafter referred to as "Husband"), and

{{wife_full_name}} (Identity Number: {{wife_id_number}}), residing at {{wife_address}} (hereinafter referred to as "Wife").

Husband and Wife are legally married to each other, having solemnized their marriage on {{date_of_marriage}} at {{place_of_marriage}}.

RECITALS

WHEREAS, Husband and Wife desire to define and clarify their respective rights and obligations with respect to their separate and marital property, debts, and income, both current and future, in the event of death, divorce, or separation.

WHEREAS, both Husband and Wife have been advised of their legal rights and obligations concerning this Agreement, have had the opportunity to seek independent legal counsel, and enter into this Agreement freely and voluntarily.

WHEREAS, both parties desire to promote harmony and minimize potential disputes should their marriage terminate.

SEPARATE PROPERTY

Each party shall retain and have full control over his or her Separate Property, as listed in Schedule A (for Husband) and Schedule B (for Wife) attached hereto, which includes, but is not limited to, all assets owned by either party prior to the marriage, and all assets acquired by gift, inheritance, or bequest during the marriage. Each party agrees to execute any documents necessary to confirm and give effect to this provision.

Separate Property shall also include any income derived from, or appreciation of, such Separate Property.

MARITAL PROPERTY

All property acquired by either party or both parties from the date of marriage until the termination of this Agreement, which is not defined as Separate Property, shall be considered Marital Property. In the event of divorce or separation, Marital Property shall be divided as follows: {{marital_property_division_terms}}.

Debts incurred by either party during the marriage, other than those specifically designated as separate debts, shall be considered marital debts and shall be divided as follows: {{marital_debt_division_terms}}.

SPOUSAL SUPPORT / ALIMONY

In the event of divorce or legal separation, the parties agree that spousal support (alimony) shall be addressed as follows: {{spousal_support_terms}}. This includes the waiver or provision of support and its duration and amount.

DISCLOSURE OF ASSETS AND LIABILITIES

Each party acknowledges that they have made a full and complete disclosure of all their assets, liabilities, income, and expectations to the other party, as detailed in Schedule C attached hereto. Each party confirms that they understand and accept the financial disclosures made by the other party and believe them to be accurate and complete.

GOVERNING LAW

This Agreement shall be construed in accordance with and governed by the laws applicable in {{jurisdiction}}, Republic of South Africa (or other specific Southern African country).

AMENDMENT AND REVOCATION

This Agreement may only be amended or revoked by a subsequent written agreement signed by both Husband and Wife. Any oral agreements or understandings shall be null and void.
