1. Introduction
This Warranty and Guarantee Policy (hereinafter referred to as “the Policy”) sets out the terms and conditions under which {{company_name}} (hereinafter referred to as “the Company”) provides warranties and guarantees for its products to customers (hereinafter referred to as “the Customer”). By purchasing products from the Company, the Customer agrees to be bound by the terms of this Policy. This Policy is in compliance with applicable consumer protection laws in Southern Africa.
2. Definitions
**Warranty Period:** The specified duration from the date of purchase during which the Company undertakes to repair or replace a defective product.
**Guarantee:** A formal assurance or promise that products will meet certain standards or conditions.
**Defective Product:** A product that is faulty due to manufacturing defects or materials, and not as a result of misuse, accident, or normal wear and tear.
**Date of Purchase:** The date on which the product was originally bought by the Customer, as evidenced by a valid proof of purchase.
3. Warranty Coverage
The Company warrants that its products will be free from defects in material and workmanship under normal use and service for a period of {{warranty_period_in_months}} months from the Date of Purchase, unless otherwise specified for a particular product. This warranty covers manufacturing defects and does not extend to damages caused by:
a) Accidental damage, misuse, abuse, neglect, or improper installation by the Customer.
b) Unauthorized modifications, repairs, or alterations.
c) Normal wear and tear, including cosmetic damage.
d) Failure to follow product instructions or maintenance guidelines.
e) Environmental factors or acts of God (e.g., natural disasters, power surges).
4. Guarantee Details
In addition to the warranty, the Company guarantees that its products are fit for their intended purpose and are of acceptable quality. Should a product fail to meet these standards within the Warranty Period, the Customer may be entitled to a repair, replacement, or refund as determined by the Company and in accordance with consumer protection laws.
Specific product guarantees, if any, will be clearly stated at the point of sale or within the product documentation.
5. Making a Warranty or Guarantee Claim
To make a claim under this Policy, the Customer must:
a) Notify the Company within {{notice_period_in_days}} days of discovering the defect, by contacting {{customer_service_contact_method}}.
b) Provide a valid proof of purchase (e.g., sales receipt, invoice) clearly indicating the Date of Purchase, product description, and purchase price.
c) Provide a detailed description of the defect or issue.
d) Return the product to the Company at {{return_address}} or as otherwise instructed by the Company, at the Customer's expense, unless otherwise specified by law.
6. Assessment and Resolution
Upon receipt of a returned product and valid claim, the Company will assess the product to determine the nature of the defect. If the defect is covered by this Policy, the Company will, at its discretion, either:
a) Repair the defective product using new or refurbished parts.
b) Replace the defective product with a new or refurbished equivalent model.
c) Issue a refund for the purchase price of the product.
The Company aims to resolve all claims within a reasonable timeframe, typically within {{resolution_period_in_days}} business days of receiving the product.
7. Exclusions and Limitations
This Policy is the sole and exclusive warranty provided by the Company. Any implied warranties, including but not limited to implied warranties of merchantability and fitness for a particular purpose, are hereby disclaimed to the maximum extent permitted by law. The Company shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use its products.
The maximum liability of the Company under this Policy shall be limited to the purchase price of the product in question.
8. Governing Law
