Call Center and Telemarketing Agreement
This Call Center and Telemarketing Agreement ('Agreement') is made and entered into on this {{date_of_agreement}}
BETWEEN:
{{company_name}} (hereinafter referred to as the 'Company'), a company duly registered under the laws of {{country}}, with its principal place of business at {{company_address}}.
AND
{{employee_name}} (hereinafter referred to as the 'Employee'), identity number {{employee_id_number}}, residing at {{employee_address}}.
The Company and the Employee are hereinafter collectively referred to as the 'Parties' and individually as a 'Party'.
1. Position and Duties
1.1. The Company hereby employs the Employee in the position of {{position_title}}.
1.2. The Employee shall perform such duties as are customarily associated with this position, as well as any other reasonable duties assigned by the Company from time to time. These duties shall include, but not be limited to, {{duty_1}}, {{duty_2}}, and {{duty_3}}.
1.3. The Employee shall report to {{reporting_manager}} or such other person as the Company may designate.
2. Commencement and Duration
2.1. This Agreement shall commence on {{start_date}} ('Commencement Date') and shall continue until terminated in accordance with the provisions of this Agreement.
2.2. The first {{probation_period_months}} months of employment shall be a probationary period, during which time either Party may terminate this Agreement with {{probation_notice_period}} days' written notice.
3. Remuneration
3.1. The Employee's gross monthly salary shall be {{currency}} {{salary_amount}} ({{salary_amount_words}}) payable on or before the last day of each month.
3.2. In addition to the basic salary, the Employee may be eligible for performance-based commission as per the Company's commission structure, as amended from time to time. Details of the commission structure are attached as Schedule A.
3.3. All statutory deductions, including but not limited to pay-as-you-earn (PAYE) tax and unemployment insurance fund (UIF) contributions, will be made from the Employee's salary.
4. Working Hours and Leave
4.1. The Employee's normal working hours shall be from {{start_time}} to {{end_time}}, {{days_of_week}}.
4.2. The Employee shall be entitled to {{annual_leave_days}} days of paid annual leave per annum, to be taken at a time mutually agreed upon with the Company.
4.3. The Employee shall be entitled to sick leave and other statutory leave benefits as prescribed by the applicable labour laws of {{country}}.
5. Confidentiality and Non-Disclosure
5.1. The Employee acknowledges that during the course of employment, they will have access to confidential information belonging to the Company and its clients, including but not limited to {{confidential_information_type_1}}, {{confidential_information_type_2}}, and {{confidential_information_type_3}}.
5.2. The Employee undertakes not to disclose, directly or indirectly, any confidential information to any third party during or after the termination of their employment, except as required by law or with the prior written consent of the Company.
6. Code of Conduct and Compliance
6.1. The Employee agrees to adhere to the Company's code of conduct, policies, and procedures as may be implemented and amended from time to time.
6.2. The Employee shall comply with all applicable laws and regulations relating to telemarketing and call center operations, including but not limited to those concerning data protection, consumer rights, and unsolicited communications.
7. Termination of Employment
7.1. This Agreement may be terminated by either Party by giving {{notice_period_weeks}} weeks' written notice to the other Party.
7.2. The Company reserves the right to terminate this Agreement without notice in the event of gross misconduct or other serious breaches of this Agreement by the Employee.
8. Governing Law and Jurisdiction
8.1. This Agreement shall be governed by and construed in accordance with the laws of {{country}}.
8.2. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of {{country}}.
