EMPLOYMENT CONTRACT

This Employment Contract (“Agreement”) is made and entered into on this {{day}} day of {{month}}, {{year}} (“Effective Date”), by and between:

{{company_name}}, a company duly incorporated and registered under the laws of {{country_of_incorporation}}, with its principal place of business at {{company_address}} (hereinafter referred to as “the Employer”);

AND

{{employee_full_name}}, Identity Number {{employee_id_number}}, residing at {{employee_residential_address}} (hereinafter referred to as “the Employee”).

1. COMMENCEMENT OF EMPLOYMENT

The Employee’s employment with the Employer shall commence on {{start_date}}.

2. POSITION AND DUTIES

2.1. The Employer hereby employs the Employee in the position of {{job_title}}.

2.2. The Employee shall report directly to {{reporting_manager}}.

2.3. The Employee’s duties and responsibilities shall include, but are not limited to, those outlined in the attached Job Description (Annexure A), which may be updated from time to time by the Employer at its sole discretion.

2.4. The Employee agrees to diligently and faithfully perform all duties assigned by the Employer and to comply with all lawful and reasonable instructions given by the Employer.

3. REMUNERATION

3.1. The Employee’s gross monthly salary shall be {{currency}} {{salary_amount}}.

3.2. Salaries shall be paid monthly in arrears, on or before the {{payment_day}} day of each month, by direct deposit into the Employee’s nominated bank account.

3.3. The Employee shall be responsible for statutory deductions (e.g., PAYE, UIF, etc.) as required by law.

3.4. The Employer may, at its discretion, review the Employee’s remuneration annually.

4. WORKING HOURS

4.1. The Employee’s normal working hours shall be from {{start_time}} to {{end_time}}, Monday to Friday.

4.2. The Employee may be required to work reasonable overtime as and when required by the Employer, for which compensation will be in accordance with relevant labour legislation.

5. LEAVE ENTITLEMENTS

5.1. The Employee shall be entitled to annual leave, sick leave, and family responsibility leave in accordance with the provisions of the relevant labour legislation in force in {{country_of_employment}}.

5.2. Annual leave shall accrue at a rate of {{annual_leave_days}} working days per annum.

5.3. All leave must be applied for and approved in advance by {{approving_manager}}.

6. PROBATIONARY PERIOD

6.1. The Employee’s employment shall be subject to a probationary period of {{probationary_period_months}} months, commencing on the Effective Date.

6.2. During the probationary period, the Employer shall assess the Employee’s performance, conduct, and suitability for the position.

6.3. The Employer may, at its discretion, extend the probationary period or terminate the Employee’s employment during or at the end of the probationary period, subject to applicable legal requirements.

7. CONFIDENTIALITY

7.1. The Employee acknowledges that during the course of employment, they will have access to confidential and proprietary information belonging to the Employer.

7.2. The Employee undertakes to keep all such information strictly confidential, both during and after the termination of employment, and not to disclose it to any third party or use it for any purpose other than for the benefit of the Employer.

8. TERMINATION OF EMPLOYMENT

8.1. This Agreement may be terminated by either party upon giving written notice to the other party, in accordance with the minimum notice periods prescribed by the labour legislation of {{country_of_employment}}.

8.2. The Employer may terminate this Agreement without notice in instances Gross Misconduct, as defined by the Employer’s disciplinary code.

8.3. Upon termination of employment, the Employee shall return all company property in their possession.

9. GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of {{country_of_employment}}.
