POST-NUPTIAL AGREEMENT

This Post-Nuptial Agreement ('Agreement') is made and entered into on this {{day}} day of {{month}}, {{year}}, by and between:

{{Party_A_Full_Name}}, residing at {{Party_A_Address}} (hereinafter referred to as 'Party A'),

AND

{{Party_B_Full_Name}}, residing at {{Party_B_Address}} (hereinafter referred to as 'Party B').

(Party A and Party B are sometimes collectively referred to as 'the Parties' and individually as a 'Party').

RECITALS

WHEREAS, the Parties were lawfully married on {{Marraige_Date}} in {{Marraige_Location}};

WHEREAS, the Parties desire to define and clarify their respective rights, duties, and obligations with respect to their property, income, and assets, both presently owned and hereafter acquired, and to make provision for the distribution of their property in the event of divorce, separation, or death;

WHEREAS, both Parties have been advised to seek independent legal counsel and have either done so or have knowingly elected to waive such counsel;

WHEREAS, both Parties have made full and fair disclosure of their respective financial conditions to each other, including all assets, liabilities, income, and expenses (as detailed in Schedule A and Schedule B attached hereto);

NOW, THEREFORE, in consideration of the mutual covenants and promises herein contained, and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the Parties agree as follows:

DISCLOSURE OF ASSETS AND LIABILITIES

Each Party represents and warrants that they have provided full, accurate, and complete disclosure of their assets and liabilities as of the date of this Agreement. Schedule A, attached hereto and incorporated by reference, sets forth Party A's current assets and liabilities. Schedule B, attached hereto and incorporated by reference, sets forth Party B's current assets and liabilities.

The Parties acknowledge that they have been given the opportunity to review and verify the financial disclosures of the other Party and understand that these disclosures are a material basis for entering into this Agreement.

SEPARATE PROPERTY

Each Party shall have and retain sole ownership, control, and enjoyment of their respective Separate Property, free from any claim or interference by the other Party. Separate Property shall include, but not be limited to:

a. All property, real or personal, owned by each Party prior to the marriage, as detailed in Schedule A (for Party A) and Schedule B (for Party B).

b. All property acquired by each Party by gift, devise, or inheritance during the marriage.

c. All income, rents, profits, and proceeds derived from Separate Property.

d. Any appreciation in the value of Separate Property, regardless of whether such appreciation is due to market forces or efforts of either Party.

Each Party shall have the exclusive right to manage, encumber, sell, transfer, hypothecate, or otherwise dispose of their Separate Property without the consent or joinder of the other Party.

MARITAL PROPERTY (JOINT PROPERTY)

Marital Property shall consist of all property, real or personal, hereafter acquired by the Parties during the marriage that is not designated as Separate Property under the terms of this Agreement. This may include, but is not limited to:

a. All salaries, wages, bonuses, and other income earned by either Party during the marriage.

b. Property purchased jointly by the Parties.

c. Property held in joint tenancy, tenancy by the entirety, or as community property.

In the event of separation, divorce, or death, Marital Property shall be divided equally between the Parties, unless otherwise specified herein or agreed upon in writing by both Parties.

DEBTS AND LIABILITIES

Each Party shall be solely responsible for and indemnify the other Party against all debts and liabilities incurred by that Party prior to the marriage, as detailed in Schedule A and Schedule B, and any debts incurred independently by that Party after the date of this Agreement which are not for the joint benefit of the Parties.

Joint debts incurred during the marriage for the benefit of both Parties shall be the joint responsibility of both Parties and shall be divided equally in the event of divorce or separation, unless otherwise agreed upon in writing.

WAIVER OF SPOUSAL SUPPORT/ALIMONY

Except as otherwise provided for in this Agreement, each Party hereby waives and relinquishes any and all rights and claims to spousal support, maintenance, or alimony from the other Party, whether temporary, rehabilitative, or permanent, in the event of separation or divorce.

GOVERNING LAW

This Agreement shall be construed in accordance with and governed by the laws of {{country_name}}.

BINDING EFFECT

This Agreement shall be binding upon and inure to the benefit of the Parties and their respective heirs, executors, administrators, personal representatives, successors, and assigns.

ENTIRE AGREEMENT

This Agreement constitutes the entire understanding and agreement between the Parties with respect to the subject matter hereof and supersedes all prior agreements, understandings, negotiations, and discussions, whether oral or written, between the Parties.
