Co-Habitation Agreement

This Co-Habitation Agreement (the 'Agreement') is made and entered into on this {{day}} day of {{month}}, {{year}}, by and between:

Party A: {{party_a_full_name}}, residing at {{party_a_address}}, (hereinafter referred to as 'Party A').

AND

Party B: {{party_b_full_name}}, residing at {{party_b_address}}, (hereinafter referred to as 'Party B').

Collectively, Party A and Party B shall be referred to as 'the Parties'.

Recitals

WHEREAS, the Parties intend to cohabitate at the property located at {{cohabitation_address}} (the 'Property');

WHEREAS, the Parties desire to define their respective rights, duties, and obligations with respect to their financial affairs, property, and support during the period of their cohabitation and in the event of separation;

Financial Contributions and Joint Accounts

The Parties agree to contribute to household expenses as follows: {{financial_contribution_details}}.

Any joint bank accounts established by the Parties shall be for the sole purpose of covering shared living expenses and shall be managed as follows: {{joint_account_management_details}}.

Each Party shall retain full ownership and control over their individual bank accounts and assets acquired prior to or independently during the cohabitation, unless explicitly stated otherwise in this Agreement.

Property Ownership and Division

All property acquired by either Party individually prior to the commencement of cohabitation shall remain the sole property of that Party.

Property acquired jointly during cohabitation shall be owned in the following proportions: {{joint_property_ownership_proportions}}. In the event of separation, such jointly acquired property shall be divided as follows: {{joint_property_division_details}}.

Any improvements or additions made to the Property by either Party shall be treated as follows: {{property_improvements_details}}.

Debts and Liabilities

Each Party shall be solely responsible for their individual debts and liabilities incurred prior to or during the cohabitation, unless such debts are jointly incurred and explicitly detailed in this Agreement.

Jointly incurred debts shall be the responsibility of both Parties in the following proportions: {{joint_debt_responsibility_proportions}}. In the event of separation, such debts shall be settled as follows: {{joint_debt_settlement_details}}.

Maintenance and Support

The Parties agree that there shall be no obligation for spousal maintenance or financial support by either Party to the other upon separation, unless expressly provided for herein: {{maintenance_provision_details}}.

Dispute Resolution

In the event of any dispute arising out of or in connection with this Agreement, the Parties agree to first attempt to resolve the dispute through good faith negotiations. If negotiations are unsuccessful, the Parties agree to engage in mediation with a mutually agreed-upon mediator before resorting to litigation.

The costs of mediation shall be borne as follows: {{mediation_cost_details}}.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of {{applicable_jurisdiction}}.

Severability

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

Entire Agreement

This Agreement constitutes the entire understanding and agreement between the Parties with respect to the subject matter hereof and supersedes all prior agreements, understandings, negotiations, and discussions, whether oral or written, between the Parties.
