Agreement to Cancel Lease

This Agreement to Cancel Lease is made and entered into on this {{date_of_agreement}} day of {{month}}, {{year}}, by and between:

Landlord: {{landlord_name}}, residing at/with principal place of business at {{landlord_address}} (hereinafter referred to as “the Landlord”) AND

Tenant: {{tenant_name}}, residing at {{tenant_address}} (hereinafter referred to as “the Tenant”)

Recitals

WHEREAS, the Landlord and the Tenant entered into a Lease Agreement dated {{original_lease_start_date}} (hereinafter referred to as “the Original Lease”) for the property located at {{property_address}} (hereinafter referred to as “the Property”); and

WHEREAS, the original term of the Original Lease is set to expire on {{original_lease_end_date}}; and

WHEREAS, both parties mutually desire to terminate the Original Lease earlier than its stated expiration date, subject to the terms and conditions set forth herein.

Early Termination Date

The Landlord and the Tenant hereby agree that the Original Lease shall be terminated, and the Tenant shall vacate the Property, on or before {{early_termination_date}} (hereinafter referred to as “the Early Termination Date”).

Financial Obligations and Settlement

1. The Tenant shall be responsible for all rent, utilities, and other charges as stipulated in the Original Lease up to and including the Early Termination Date.

2. The Tenant agrees to pay a lease termination fee of {{termination_fee_amount}} ({{currency}}) to the Landlord on or before {{payment_due_date}}.

3. The Landlord shall return the security deposit of {{security_deposit_amount}} ({{currency}}) to the Tenant, less any deductions for damages beyond normal wear and tear, and any outstanding financial obligations, within {{days_to_return_deposit}} days after the Early Termination Date and after inspection of the Property.

4. Any outstanding amounts owed by either party to the other, as per the Original Lease and this Agreement, shall be settled by {{settlement_date}}.

Property Condition and Handover

1. The Tenant agrees to surrender possession of the Property in a clean, broom-swept condition, and in good repair, reasonable wear and tear excepted, on the Early Termination Date.

2. The Tenant shall remove all personal belongings from the Property by the Early Termination Date. Any items left behind shall be deemed abandoned and may be disposed of by the Landlord at the Tenant’s expense.

3. A joint inspection of the Property shall be conducted by both the Landlord and the Tenant on {{inspection_date}} at {{inspection_time}} to document the condition of the Property.

Release and Indemnification

Upon full execution of this Agreement and satisfactory compliance with all its terms, the Landlord and the Tenant mutually release each other from any further obligations, liabilities, claims, or demands arising from the Original Lease, except for those specifically reserved or surviving this Agreement.

Both parties agree to indemnify and hold harmless the other from any claims or damages arising from their respective actions or inactions concerning the Property prior to the Early Termination Date.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of [{{country}}].

Entire Agreement

This Agreement constitutes the entire agreement between the Landlord and the Tenant with respect to the early termination of the Original Lease and supersedes all prior discussions, negotiations, and agreements, whether oral or written.
