WEB SITE HOSTING AGREEMENT

This Web Site Hosting Agreement ("Agreement") is entered into on this {{date}} day of {{month}}, {{year}}, by and between:

{{service_provider_company_name}}, a company duly incorporated in accordance with the laws of South Africa, with its principal place of business at {{service_provider_address}} (hereinafter referred to as "the Host"); and

{{client_company_name}}, a company duly incorporated in accordance with the laws of South Africa, with its principal place of business at {{client_address}} (hereinafter referred to as "the Client").

1. SERVICES PROVIDED

1.1. The Host agrees to provide web site hosting services for the Client's website, accessible via the domain name {{domain_name}}, on the Host's servers.

1.2. The Hosting Package includes the following specifications:

- Disk Space: {{disk_space}} GB

- Monthly Bandwidth: {{bandwidth}} GB

- Email Accounts: {{number_of_email_accounts}}

- Databases: {{number_of_databases}}

- Uptime Guarantee: {{uptime_guarantee}}%

1.3. Additional services, if required, shall be agreed upon in writing and may incur additional charges.

2. TERM AND TERMINATION

2.1. This Agreement shall commence on {{start_date}} and continue for an initial term of {{initial_term}} (e.g., twelve months) ("Initial Term").

2.2. Upon expiration of the Initial Term, this Agreement shall automatically renew for successive periods of {{renewal_period}} (e.g., twelve months) unless either party provides written notice of non-renewal at least {{notice_period_days}} days prior to the end of the then-current term.

2.3. Either party may terminate this Agreement immediately upon written notice if the other party breaches any material provision of this Agreement and fails to remedy such breach within {{cure_period_days}} days of receiving written notice thereof.

3. FEES AND PAYMENT

3.1. The Client agrees to pay the Host a monthly hosting fee of {{currency}} {{hosting_fee}} (excluding VAT/tax).

4. CLIENT RESPONSIBILITIES

4.1. The Client is responsible for providing all content for their website and ensuring its legality and compliance with all applicable laws.

4.2. The Client is responsible for maintaining the security of their website applications and data, including but not limited to, strong passwords and regular updates of content management systems.

4.3. The Client shall not use the hosting services for any illegal or unethical activities, including but not limited to, spamming, distribution of malware, or infringement of intellectual property rights.

5. HOST RESPONSIBILITIES

5.1. The Host agrees to use commercially reasonable efforts to ensure the continuous availability of the hosting services, subject to scheduled maintenance and unforeseen outages.

5.2. The Host will provide technical support during business hours: {{support_hours}}.

5.3. The Host will implement routine data backups as per the specified backup frequency, but the Client remains solely responsible for their own data backups.

6. LIMITATION OF LIABILITY

6.1. The Host shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, or business interruption, arising out of or in connection with this Agreement.

6.2. The Host's total liability under this Agreement shall not exceed the total amount of fees paid by the Client to the Host in the {{previous_months}} months preceding the event giving rise to the claim.

7. GOVERNING LAW AND DISPUTE RESOLUTION

7.1. This Agreement shall be governed by and construed in accordance with the laws of {{country}}.

7.2. Any dispute or claim arising out of or in connection with this Agreement, including its existence, validity, or termination, shall be resolved through good faith negotiations between the parties.

8. ENTIRE AGREEMENT
