Preamble
The real estate profession is dedicated to serving the public with fidelity and integrity. This Code of Ethics sets forth the ethical obligations of all real estate agents and brokers (hereinafter referred to as "agents") associated with {{company_name}}, embodying principles of honesty, professionalism, and commitment to clients and the community. Adherence to these principles is fundamental to maintaining the public's trust and the integrity of our profession.
Article 1: Duty to Clients
Agents shall pledge themselves to protect and promote the interests of their clients. This primary duty to the client does not relieve agents of their obligation to treat all parties honestly and fairly.
1.1. Agents shall market property in accordance with the client's instructions and within the bounds of all applicable laws and regulations.
1.2. Agents shall keep confidential all information entrusted to them by clients, unless disclosure is required by law or pertains to material facts about a property.
1.3. Agents shall provide competent service to all clients. Where an agent is not competent to provide a particular service, they shall not undertake to provide such service or shall recommend the assistance of a competent professional.
1.4. Agents shall present all offers and counter-offers objectively and as quickly as possible.
1.5. Agents shall endeavor to be knowledgeable and informed about real estate matters pertinent to their area and client needs.
Article 2: Fair Dealing with All Parties
Agents shall treat all parties to a transaction honestly. Agents shall not intentionally misrepresent facts or mislead any party.
Article 3: Disclosure of Material Facts
Agents shall disclose all known material facts concerning a property or a transaction that are not readily apparent to a buyer or seller. This includes, but is not limited to, defects, adverse environmental conditions, or significant encumbrances.
Article 4: Confidentiality
Agents shall maintain strict confidentiality with regard to client information, including financial information and motivations, unless authorized by the client to disclose or legally compelled to do so. This duty of confidentiality extends beyond the termination of the agency relationship.
Article 5: Conflict of Interest
Agents shall avoid conflicts of interest. Should a potential conflict arise, agents shall disclose it fully to all affected parties and obtain their informed consent. Agents shall not receive any undisclosed commission, rebate, or advantage from expenditures made for a principal.
Article 6: Professional Competence
Agents shall constantly strive to increase their knowledge and improve their skills, ensuring they remain competent in all areas of their practice. This includes staying updated on legal changes, market trends, and best practices in the real estate industry.
Article 7: Compliance with Laws
Agents shall comply with all local, provincial/state, and national laws, regulations, and ordinances governing real estate practices, including fair housing laws and anti-discrimination legislation. Any violation of these laws will be considered a serious breach of this Code.
Article 8: Dispute Resolution
In the event of a dispute between an agent and a client or another party, agents are encouraged to seek resolution through amicable means, including mediation, before resorting to litigation, where appropriate and legally permissible.
