1. Purpose and Scope

This Call Center and Telemarketing Agreement ('Agreement') sets forth the terms and conditions governing the employment of individuals ('Employee') engaged in call center and telemarketing activities for {{company_name}} ('Company'). This Agreement applies to all employees involved in inbound and outbound customer communication, sales, support, and lead generation.

The Employee acknowledges and agrees to adhere to all Company policies, procedures, and guidelines as may be implemented and updated from time to time, including but not limited to, the Company's Code of Conduct, Data Protection Policy, and Social Media Policy.

2. Commencement of Employment

This Agreement shall commence on {{start_date}} and shall continue until terminated in accordance with the provisions herein.

The Employee's position will be {{job_title}} within the Company's call center/telemarketing department.

3. Duties and Responsibilities

The Employee shall perform all duties and responsibilities assigned by the Company, which may include, but are not limited to, making outbound calls, receiving inbound calls, assisting customers with inquiries, resolving complaints, processing orders, generating leads, and achieving sales targets.

The Employee is expected to maintain a professional demeanor, communicate effectively and respectfully with clients and colleagues, and uphold the Company's reputation at all times.

Specific performance targets and key performance indicators (KPIs) will be communicated to the Employee regularly, and performance will be reviewed on a {{performance_review_frequency}} basis.

4. Working Hours and Compensation

Normal working hours shall be {{hours_per_day}} hours per day, {{days_per_week}} days per week, from {{start_time}} to {{end_time}}, with a {{break_duration}} lunch break. Specific shifts may vary and will be communicated in advance.

5. Confidentiality and Data Protection

The Employee acknowledges that they will have access to confidential information, including but not limited to, customer data, sales strategies, and proprietary business information. The Employee agrees to keep all such information strictly confidential, both during and after the term of employment.

The Employee must comply with all applicable data protection laws and regulations, including the Protection of Personal Information Act (POPIA) in South Africa, or equivalent legislation in the relevant Southern African jurisdiction.

Any unauthorised disclosure or misuse of confidential information will be considered a serious breach of this Agreement and may lead to disciplinary action, including termination of employment and legal recourse.

6. Code of Conduct and Professionalism

The Employee shall adhere to the highest standards of professionalism and ethical conduct when representing the Company. This includes, but is not limited to, courteous communication, accurate representation of products/services, and adherence to company scripts and guidelines.

The Company maintains a zero-tolerance policy for harassment, discrimination, or abusive behaviour towards colleagues or customers.

The use of Company equipment and resources for personal purposes is strictly prohibited.

7. Training and Development

The Company will provide necessary training to the Employee to ensure they are equipped to perform their duties effectively. The Employee agrees to participate actively in all mandatory training programs.

Ongoing coaching and performance feedback will be provided to support the Employee's development.

8. Termination of Employment

Either party may terminate this Agreement by giving {{notice_period}} written notice to the other party.

The Company reserves the right to terminate this Agreement without notice in cases of serious misconduct, gross negligence, or breach of confidentiality, as defined by Company policy and applicable labor laws.

Upon termination, the Employee shall immediately return all Company property, including but not limited to, laptops, mobile phones, access cards, and confidential documents.

9. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of {{country_of_jurisdiction}}.
