Purpose and Scope
The purpose of this policy is to ensure a safe, healthy, and productive work environment for all employees and to protect company assets, property, and reputation. This policy applies to all employees of {{company_name}}, including temporary staff, contractors, and interns, and covers all company premises, vehicles, and work-related functions.
The misuse of alcohol, illegal drugs, and controlled substances can significantly impair an employee's ability to perform their job duties safely and effectively, potentially endangering themselves, colleagues, and the public. Prohibited Conduct
Employees are strictly prohibited from:
1. Reporting to work or remaining at work while under the influence of alcohol, illegal drugs, or controlled substances.
2. Using, possessing, distributing, selling, or offering to sell illegal drugs or controlled substances on company premises, in company vehicles, or during working hours.
3. Consuming alcohol on company premises or during working hours, except as specifically authorized by management for company-sponsored events.
4. Misusing prescription or over-the-counter medications in a manner that impairs job performance or safety.
5. Refusing to submit to a drug or alcohol test when requested in accordance with this policy.
Drug and Alcohol Testing Procedures
{{company_name}} may conduct drug and alcohol testing under the following circumstances:
A. Pre-employment Testing: All potential new hires for designated positions may be required to undergo drug and alcohol testing as a condition of employment. An offer of employment is contingent upon a negative test result.
B. Reasonable Suspicion Testing: Employees may be required to undergo drug and alcohol testing when there is reasonable suspicion that they are under the influence of drugs or alcohol. Reasonable suspicion may be based on observable phenomena such as direct observation of drug or alcohol use, patterns of abnormal or erratic behavior, slurred speech, body odor, or evidence of possession of drugs or alcohol.
C. Post-Accident Testing: Employees involved in workplace accidents or incidents that result in injury, property damage, or near-misses may be required to undergo drug and alcohol testing.
D. Random Testing: For certain safety-sensitive positions, employees may be subject to unannounced, random drug and alcohol testing.
E. Return-to-Duty Testing: Employees who have violated this policy and wish to return to work after completing a substance abuse program may be required to undergo a return-to-duty test.
All testing will be conducted by a certified third-party vendor in a confidential and professional manner, in accordance with applicable laws and regulations. Employees will be provided with information about the testing process and their rights.
Consequences of Policy Violations
Violations of this policy will result in disciplinary action, up to and including termination of employment. The severity of the disciplinary action will depend on the nature and severity of the violation, as well as any prior offenses.
Positive test results for illegal drugs or controlled substances, refusal to test, or tampering with a test sample will typically result in immediate termination of employment.
Employees who test positive for alcohol or misuse prescription medication may face a range of disciplinary actions from written warnings to termination, depending on the circumstances and the impact on their ability to perform their duties safely and effectively.
Confidentiality
All information related to drug and alcohol testing, including test results, will be treated with strict confidentiality. Such information will only be disclosed on a need-to-know basis, as required by law, or with the employee's written consent.
Employee Assistance Program (EAP)

While this policy outlines strict measures against substance abuse, employees who voluntarily seek help for drug or alcohol problems before a policy violation occurs are encouraged to utilize our Employee Assistance Program (EAP). The EAP offers confidential counseling and referral services. Participation in the EAP will not protect an employee from disciplinary action for a violation of this policy that has already occurred or is subsequently discovered.
