1. Purpose
This policy outlines the guidelines and procedures for employees serving in the armed forces and those called to active military duty. {{company_name}} is committed to complying with all applicable laws regarding military leave, including the Uniformed Services Employment and Reemployment Rights Act (USERRA) in relevant jurisdictions, and ensuring that employees fulfilling their military obligations are protected in their employment.
2. Eligibility
This policy applies to all full-time and part-time employees of {{company_name}} who are members of the uniformed services (including the Army, Navy, Air Force, Marine Corps, Coast Guard, National Guard, and Reserves) and are called to active duty or for training.
Employees are required to provide advance written or verbal notice of their military service to {{manager_name}} or the HR Department, unless military necessity prevents such notice.
3. Duration and Type of Leave
Military leave may be granted for various types of service, including:
- Active duty
- Training (annual training, drills, etc.)
- Inactive duty for training
- Funeral honors duty
- Periods for examination to determine fitness for service.
The duration of military leave will comply with legal requirements and will be unpaid, unless otherwise specified by local regulations or company policy.
4. Compensation and Benefits During Leave
Employees on military leave will generally not receive regular pay from {{company_name}}.
Medical and dental benefits may be continued for a limited period as required by law (e.g., USERRA), with the employee potentially responsible for paying the full premium. Employees should contact HR for specific details regarding their benefits continuation options.
Accrual of vacation, sick leave, and other benefits may be suspended during military leave and will resume upon the employee's reemployment.
Employees are advised to consult with the HR Department well in advance of their military leave to understand their specific benefits situation.
5. Reemployment Rights
Upon satisfactory completion of military service, employees have reemployment rights in accordance with applicable laws.
Employees must apply for reemployment within the legally mandated timeframe following their release from service (e.g., typically within 90 days for service over 180 days, shorter periods for shorter service durations).
Upon reemployment, employees will be reinstated to the position they would have attained if they had not been absent for military service, or to a comparable position, with the same seniority, status, pay, and benefits, unless circumstances make it impossible or unreasonable to do so.
6. Responsibilities of the Employee
Provide advance notice of military service whenever possible.
Provide documentation of military service and discharge upon request.
Apply for reemployment within the specified time limits.
Keep {{company_name}} informed of any changes to contact information during leave.
7. Contact Information
For any questions regarding this Military Leave Policy, employees should contact:
