OVERTIME POLICY GUIDANCE

**Policy Number:** {{policy_number}}

**Effective Date:** {{effective_date}}

**Revision Date:** {{revision_date}}

1. Purpose and Scope

This Overtime Policy Guidance document outlines the principles and procedures governing overtime work at {{company_name}}. The aim is to ensure fair compensation for additional hours worked, maintain employee well-being, and comply with all relevant labour legislation within the Southern African context. This policy applies to all employees of {{company_name}} classified as eligible for overtime pay.

2. Definition of Overtime

Overtime is defined as any work performed by an eligible employee beyond their scheduled ordinary working hours as stipulated in their employment contract and in accordance with applicable labour laws. Ordinary working hours are typically {{ordinary_hours_per_day}} hours per day and {{ordinary_hours_per_week}} hours per week.

3. Overtime Authorization and Approval

All overtime work must be pre-approved by the employee's direct manager or a designated department head. Unauthorised overtime will not be compensated. Employees are required to complete an Overtime Request Form ({{form_name}}) and submit it for approval prior to commencing any overtime work. In exceptional circumstances where prior approval is not feasible, approval must be sought as soon as practicably possible after the overtime has been performed.

4. Overtime Compensation

Overtime will be compensated in accordance with the Basic Conditions of Employment Act (BCEA) or equivalent applicable labour legislation in the relevant Southern African jurisdiction. This typically involves:

- **Weekdays (Monday-Saturday):** {{overtime_rate_weekday}} times the employee's ordinary hourly rate for the first {{hours_at_x_rate}} hours, and {{overtime_rate_above_x_hours}} times the ordinary hourly rate thereafter.

- **Sundays and Public Holidays:** {{overtime_rate_sunday_public_holiday}} times the employee's ordinary hourly rate.

Employees may, in agreement with management and as permitted by law, opt for time off in lieu of payment at the applicable overtime rates. This must be formally recorded and approved.

5. Maximum Overtime Hours

Employees shall not work more than {{maximum_overtime_hours_per_week}} hours of overtime per week, unless there are exceptional circumstances agreed upon by both the employee and management in writing, and in compliance with statutory limits. The company is committed to ensuring employees receive adequate rest periods.

6. Records Keeping

All overtime hours worked must be accurately recorded on the official Overtime Register ({{register_name}}) or through the {{timekeeping_system}} system. It is the responsibility of both the employee and their manager to ensure that these records are updated and submitted promptly for payroll processing.

7. Exceptions and Exemptions

Certain positions, particularly those in senior management or professional roles, may be exempt from overtime provisions as per their employment contracts and relevant labour legislation. Any exemptions will be clearly stipulated in individual employment agreements.

8. Employee Responsibilities

Employees are responsible for:

- Seeking prior approval for any overtime work.

- Accurately recording all overtime hours worked.

- Notifying their manager of any circumstances that may prevent them from working approved overtime.

- Adhering to rest period requirements.

9. Management Responsibilities

Management is responsible for:

- Fairly assessing and approving overtime requests.

- Ensuring compliance with this policy and all labour legislation.

- Monitoring overtime hours to prevent excessive work.

- Providing adequate resources to avoid unnecessary overtime.

- Ensuring accurate record-keeping and timely processing of overtime payments.
