This policy details the provision of Paternity Leave for eligible employees of {{company_name}} ('the Company') in accordance with the Basic Conditions of Employment Act (BCEA) in South Africa and other relevant labour legislation.

1. Purpose and Scope

This policy aims to provide a clear framework for employees who wish to take paternity leave following the birth or adoption of a child. It applies to all eligible employees of {{company_name}}.

2. Eligibility for Paternity Leave

To be eligible for paternity leave, an employee must:

- Be the biological father of a child, or an adoptive parent.

- Have completed at least {{minimum_service_months}} months of continuous service with the Company prior to the expected date of birth or adoption.

- Provide the required notification and documentation as outlined in this policy.

3. Paternity Leave Entitlement

Eligible employees are entitled to {{number_of_consecutive_days}} consecutive days of paternity leave. This leave is paid at {{percentage_of_salary}}% of the employee's normal remuneration, subject to the provisions of the Unemployment Insurance Fund (UIF) Act, where applicable.

Paternity leave must be taken within {{number_of_months}} months of the child's birth or adoption date.

4. Notification Procedures

Employees must notify their immediate manager and the HR Department in writing of their intention to take paternity leave at least {{days_notice}} days before the expected commencement date of the leave.

The notification should include:

- The expected date of the child's birth or adoption.

- The proposed start and end dates of the paternity leave.

A Paternity Leave Application Form (available from the HR Department) must be completed and submitted along with supporting documentation.

5. Required Documentation

To process paternity leave, employees must submit the following documentation to the HR Department:

- A certified copy of the child’s birth certificate or official adoption order.

- A sworn affidavit confirming paternity or the adoption.

- Proof of application for benefits from the Unemployment Insurance Fund (UIF) where applicable (e.g., UI-2.8 form).

6. Return to Work

Employees are expected to return to work on the first working day following the end of their approved paternity leave period. If an employee is unable to return to work due to unforeseen circumstances, they must notify their manager and the HR Department immediately.

7. Confidentiality

All information related to an employee's paternity leave application will be treated with strict confidentiality in accordance with the company's privacy policy and applicable data protection laws.

8. Policy Review

This policy will be reviewed periodically, at least every {{review_period_in_years}} years, or as necessary to ensure compliance with legislative changes and best practices. Employees will be informed of any amendments.
