MUTUAL CANCELLATION OF LEASE AGREEMENT

This Mutual Cancellation of Lease Agreement ('Agreement') is made and entered into this {{day}} day of {{month}}, {{year}}, by and between:

Landlord: {{landlord_name}}, with a physical address of {{landlord_address}} (hereinafter referred to as the 'Landlord'),

AND

Tenant: {{tenant_name}}, with a physical address of {{tenant_address}} (hereinafter referred to as the 'Tenant').

WHEREAS, the Landlord and Tenant entered into a Lease Agreement dated {{original_lease_start_date}} for the property located at {{property_address}} (hereinafter referred to as the 'Premises'); and

WHEREAS, both parties mutually desire to terminate the said Lease Agreement prior to its original expiry date of {{original_lease_end_date}}.

MUTUAL CANCELLATION

The Landlord and Tenant hereby mutually agree to cancel and terminate the Lease Agreement dated {{original_lease_start_date}} for the Premises located at {{property_address}}, effective from {{cancellation_effective_date}} ('Effective Date').

VACATING THE PREMISES

The Tenant agrees to vacate the Premises and remove all personal belongings on or before the Effective Date. The Tenant shall surrender possession of the Premises to the Landlord in good and clean condition, reasonable wear and tear excepted.

RENT AND OUTGOINGS

The Tenant shall be responsible for the payment of all outstanding rent, utilities, and other outgoings as stipulated in the original Lease Agreement up to and including the Effective Date.

Any rent paid in advance for the period after the Effective Date shall be reimbursed to the Tenant within {{reimbursement_days}} days of the Effective Date, subject to any deductions as per this Agreement.

SECURITY DEPOSIT

The security deposit of {{security_deposit_amount}} paid by the Tenant shall be dealt with in accordance with the terms of the original Lease Agreement and applicable laws, subject to any deductions for damages beyond reasonable wear and tear, and any outstanding amounts owed by the Tenant. The Landlord shall return the balance of the security deposit, if any, to the Tenant within {{security_deposit_return_days}} days of the Effective Date.

RELEASE AND DISCHARGE

Upon mutual execution of this Agreement and full compliance with all its terms, both the Landlord and the Tenant hereby release and discharge each other from any and all further obligations, liabilities, claims, and demands arising from or related to the Lease Agreement and the tenancy of the Premises, save for any obligations or liabilities expressly stated to survive the termination of the Lease Agreement.

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of {{country/jurisdiction}}.

ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the Landlord and the Tenant concerning the mutual cancellation of the Lease Agreement and supersedes all prior discussions, negotiations, and agreements, whether oral or written.
