Casual Worker Agreement

This Casual Worker Agreement (hereinafter referred to as 'the Agreement') is entered into on this {{day}} day of {{month}}, {{year}},

BETWEEN:

{{company_name}} (Registration Number: {{company_registration_number}}), a company duly incorporated in accordance with the laws of [South Africa/ {{country}}], with its principal place of business at {{company_address}} (hereinafter referred to as 'the Employer')

AND

{{worker_name}} (Identification Number: {{worker_id_number}}), residing at {{worker_address}} (hereinafter referred to as 'the Casual Worker').

1. Nature of Engagement

1.1 The Employer hereby engages the Casual Worker, and the Casual Worker hereby accepts engagement, on a casual basis for the performance of specific tasks or services as and when required by the Employer.

1.2 This Agreement does not create a permanent employment relationship, and the Casual Worker acknowledges that there is no expectation of regular work or continuous employment.

1.3 The Employer is under no obligation to offer work to the Casual Worker, nor is the Casual Worker obliged to accept any work offered.

2. Commencement and Duration

2.1 The engagement shall commence on {{start_date}} and shall continue on a casual basis until terminated in accordance with the provisions of this Agreement.

2.2 Each engagement for specific work will be communicated to the Casual Worker, specifying the nature of the work, the expected duration, and the remuneration.

3. Duties and Responsibilities

3.1 The Casual Worker shall perform the duties as assigned by the Employer from time to time, including but not limited to: {{specific_duties}}.

3.2 The Casual Worker shall perform these duties with due diligence, skill, and in a professional manner, adhering to all reasonable instructions and policies of the Employer.

4. Remuneration

4.1 The Casual Worker shall be remunerated at a rate of {{hourly_daily_rate}} per {{hour_day}} for actual hours/days worked.

4.2 Payment shall be made {{payment_frequency}} (e.g., weekly, bi-weekly, monthly) on {{payment_day_date}} for work performed during the preceding period.

4.3 The Employer shall deduct all statutory contributions as required by law (e.g., PAYE, UIF) from the Casual Worker's remuneration, where applicable.

5. Working Hours

5.1 Working hours will be irregular and depend on the operational needs of the Employer. There are no fixed working hours.

5.2 The Employer will inform the Casual Worker of proposed working hours for specific tasks, and the Casual Worker will confirm their availability.

6. Leave and Benefits

6.1 As a casual worker, the Casual Worker is not entitled to paid annual leave, sick leave, or any other benefits associated with permanent employment, unless otherwise stipulated by law for casual workers.

6.2 Any statutory entitlements for casual workers will be adhered to by the Employer.

7. Termination of Engagement

7.1 Either party may terminate an individual engagement or this Agreement by giving {{notice_period}} notice in writing to the other party.

7.2 The Employer reserves the right to terminate this Agreement immediately for serious misconduct or breach of any terms of this Agreement by the Casual Worker.

8. Confidentiality

8.1 The Casual Worker agrees to keep confidential all proprietary and confidential information of the Employer acquired during the course of the engagement, both during and after the termination of this Agreement.

9. Governing Law

9.1 This Agreement shall be governed by and construed in accordance with the laws of {{country}}.

10. Entire Agreement

10.1 This Agreement constitutes the entire agreement between the Employer and the Casual Worker with respect to the subject matter hereof and supersedes all prior discussions, negotiations, and agreements, whether oral or written.
