EMPLOYMENT CONTRACT: DRIVER
This Employment Contract (“Contract”) is made and entered into on this {{day}} day of {{month}}, {{yearE}}
BETWEEN:
{{company_name}} (Registration Number: {{company_registration_number}}), a company duly incorporated and operating under the laws of {{country}}, with its principal place of business located at {{company_address}} (hereinafter referred to as “the Employer”),
AND
{{employee_full_name}} (Identification Number: {{employee_ID_number}}), residing at {{employee_address}} (hereinafter referred to as “the Employee”).
1. Commencement of Employment
1.1. The Employee’s employment with the Employer shall commence on {{start_date}}.
1.2. The Employee shall be employed in the capacity of a Driver.
2. Probationary Period
2.1. The Employee shall serve a probationary period of {{probationary_period_months}} months, commencing on the start date of employment.
2.2. During the probationary period, either party may terminate this Contract by giving {{probationary_notice_period_days}} days’ written notice.
2.3. Upon successful completion of the probationary period, the Employee’s employment will be confirmed, subject to the terms and conditions of this Contract.
3. Remuneration
3.1. The Employee’s gross monthly salary shall be {{salary_amount}} ({{salary_amount_words}}) payable on or before the {{payment_day}} day of each month.
3.2. Deductions for Pay As You Earn (PAYE), Unemployment Insurance Fund (UIF), and other statutory contributions will be made as required by law.
3.3. The Employer may, at its sole discretion, review the Employee’s salary annually.
4. Driver Responsibilities and Duties
4.1. The Employee's primary responsibilities include, but are not limited to, the safe and timely transportation of goods, passengers, or equipment as directed by the Employer.
4.2. Adherence to all traffic laws, regulations, and company policies.
4.3. Maintaining the cleanliness and fuel levels of the assigned vehicle.
4.4. Conducting pre-trip and post-trip inspections of the vehicle and reporting any defects or damages immediately.
4.5. Maintaining accurate logbooks and delivery records.
4.6. Assisting with loading and unloading of goods as required.
4.7. Any other duties as reasonably assigned by the Employer related to the driving function.
5. Working Hours
5.1. The Employee’s normal working hours shall be {{working_hours_per_day}} hours per day, {{working_days_per_week}} days per week, from {{start_time}} to {{end_time}}, with a {{lunch_break_minutes}}-minute unpaid lunch break.
5.2. The Employee may be required to work overtime as per operational requirements. Overtime shall be compensated in accordance with the Basic Conditions of Employment Act or relevant labour legislation in {{country}}.
5.3. Public holidays worked will be compensated in line with statutory requirements.
6. Leave
6.1. The Employee shall be entitled to annual leave, sick leave, and family responsibility leave as prescribed by the Basic Conditions of Employment Act or relevant labour legislation in {{country}}.
6.2. Annual leave accrues at a rate of {{annual_leave_days_per_year}} days per annum and must be taken with prior approval from the Employer.
7. Termination of Employment
7.1. This Contract may be terminated by either party giving written notice as follows:
7.1.1. During the probationary period: {{probationary_notice_period_days}} days’ notice.
7.1.2. After the probationary period: {{notice_period_weeks}} weeks’ notice.
7.2. The Employer may terminate this Contract summarily without notice for gross misconduct, insubordination, or breach of any material term of this Contract.
7.3. Upon termination, the Employee shall return all company property, including but not limited to, the assigned vehicle, keys, and documents.
8. Confidentiality
8.1. The Employee undertakes not to disclose any confidential information pertaining to the Employer’s business, clients, routes, or operations during or after the period of employment.
8.2. Breach of this confidentiality clause may result in disciplinary action, termination of employment, and legal proceedings.
9. General Provisions
9.1. This Contract constitutes the entire agreement between the parties and supersedes all prior agreements or understandings, whether written or oral.
9.2. No variation, amendment, or addition to this Contract shall be valid unless reduced to writing and signed by both parties.
9.3. This Contract shall be governed by and construed in accordance with the laws of {{country}}.
