PARTIES

This Domestic Worker Employment Contract (hereinafter referred to as "the Agreement") is made and entered into by and between:

{{employer_name}} of {{company_name}} (hereinafter referred to as "the Employer"), residing at {{employer_address}}, with contact number {{employer_phone}} and email address {{employer_email}}.

AND

{{employee_name}} (hereinafter referred to as "the Employee"), residing at {{employee_address}}, with Identity Number {{employee_id_number}} and contact number {{employee_phone}}.

COMMENCEMENT OF EMPLOYMENT

The Employee's employment with the Employer shall commence on {{start_date}}.

POSITION AND DUTIES

The Employee is employed as a Domestic Worker and shall perform duties typically associated with this role, including but not limited to, cleaning, laundry, ironing, cooking, childcare, and general household maintenance as instructed by the Employer.

The Employee shall perform their duties with due diligence, care, and to the best of their ability.

REMUNERATION

The Employer shall pay the Employee a gross weekly/monthly wage of {{wage_amount}} ({{wage_amount_words}}) on the {{payment_day}} of each week/month, payable via {{payment_method}} (e.g., bank transfer, cash).

Deductions: The Employer may deduct from the Employee’s wage any amounts legally permissible or agreed upon in writing by the Employee.

HOURS OF WORK

The Employee’s ordinary hours of work shall be {{hours_per_day}} hours per day, from {{start_time}} to {{end_time}}, {{days_per_week}} days per week (e.g., Monday to Friday).

Overtime: Any work performed in excess of the ordinary hours shall be considered overtime and paid at the rate prescribed by the Basic Conditions of Employment Act (BCEA) and sectoral determinations, upon prior agreement with the Employer.

LEAVE

Annual Leave: The Employee shall be entitled to {{annual_leave_days}} consecutive days’ paid annual leave per annum, to be taken at a time mutually agreed upon by the Employer and Employee.

Sick Leave: The Employee shall be entitled to paid sick leave as per the provisions of the Basic Conditions of Employment Act (BCEA).

Family Responsibility Leave: The Employee shall be entitled to paid family responsibility leave as per the provisions of the Basic Conditions of Employment Act (BCEA).

TERMINATION OF EMPLOYMENT

Either party may terminate this Agreement by giving {{notice_period}} week/month’s written notice to the other party.

In the event of a material breach of this Agreement by either party, the aggrieved party may terminate this Agreement immediately upon written notice.

Upon termination, the Employee shall be paid all outstanding wages, leave pay, and any other amounts legally due.

CONFIDENTIALITY

The Employee agrees to keep confidential all information pertaining to the Employer's household, personal affairs, and any other sensitive information obtained during the course of employment.

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of South Africa.
