1. Parties to the Agreement

This Employment Contract (“Agreement”) is made and entered into on this the {{day}} day of {{month}}, {{year}}

BETWEEN:

{{company_name}} (Registration Number: {{company_registration_number}}), a company duly incorporated in terms of the laws of {{country}}, with its principal place of business at {{company_address}} (hereinafter referred to as “the Employer”);

AND

{{employee_name}} (Identification Number: {{employee_id_number}}), residing at {{employee_address}} (hereinafter referred to as “the Employee”).

2. Commencement of Employment

The Employee’s employment with the Employer shall commence on {{start_date}}.

3. Position and Duties

3.1. The Employee is hereby employed in the position of {{job_title}}.

3.2. The Employee shall report to {{reporting_manager}}.

3.3. The Employee shall perform all duties and responsibilities as are customary for the position of {{job_title}}, as well as any other duties that may be reasonably assigned by the Employer from time to time. A detailed job description is attached hereto as Annexure A.

4. Remuneration

4.1. The Employee’s gross monthly salary shall be {{currency}} {{salary_amount}} ({{salary_amount_words}}), payable on or before the {{payment_day}} day of each month.

4.2. Deductions required by law (e.g., Pay As You Earn (PAYE), Unemployment Insurance Fund (UIF)) will be made from the Employee’s salary.

4.3. The Employer shall contribute to {{pension_fund_name}} on behalf of the Employee, as per the Employer's policy.

4.4. The Employer shall provide {{medical_aid_scheme_name}} medical aid benefits, with {{employer_contribution_percentage}}% employer contribution.

5. Working Hours

5.1. The Employee’s ordinary working hours shall be from {{start_time}} to {{end_time}}, Monday to Friday, with a {{lunch_break_duration}} lunch break.

5.2. The Employee may be required to work overtime as reasonably required by the Employer, subject to applicable labour laws and remuneration for such overtime.

6. Leave

6.1. The Employee shall be entitled to {{annual_leave_days}} working days of paid annual leave per annum, to be taken at a time mutually agreed upon with the Employer.

6.2. The Employee shall be entitled to {{sick_leave_days}} days of paid sick leave in a {{sick_leave_cycle_year}} sick leave cycle.

6.3. The Employee shall be entitled to {{family_responsibility_leave_days}} days of paid family responsibility leave per annum, under circumstances prescribed by law.

7. Probation Period

The Employee’s employment shall be subject to a probation period of {{probation_period_months}} months, ending on {{probation_end_date}}. During this period, the Employer shall assess the Employee’s suitability for the position.

8. Confidentiality and Restraint of Trade

8.1. The Employee agrees to keep confidential all proprietary and confidential information of the Employer, both during and after the termination of employment.

8.2. During the Employee’s employment and for a period of {{restraint_period_months}} months after the termination of employment, the Employee shall not directly or indirectly engage in or be concerned with any business similar to that of the Employer within a radius of {{restraint_radius_km}} kilometres from the Employer’s premises.

9. Termination of Employment

9.1. This Agreement may be terminated by either party giving {{notice_period_weeks}} weeks’ written notice.

9.2. The Employer may terminate this Agreement without notice in instances of serious misconduct by the Employee.

9.3. Upon termination of employment, the Employee shall return all company property in their possession.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of {{country}}.
