Termination Agreement

1. Parties

This Termination Agreement ("Agreement") is made and entered into this {{day}} day of {{month}}, {{year}}, by and between:

{{company_name}}, a company duly registered in accordance with the laws of {{country}}, with its principal place of business at {{company_address}} (hereinafter referred to as "the Employer"); and

{{employee_name}}, an adult individual residing at {{employee_address}}, and holding identification number {{employee_id_number}} (hereinafter referred to as "the Employee").

2. Termination Date

The Employer and the Employee hereby mutually agree that the Employee's employment with the Employer shall terminate on {{termination_date}} (hereinafter referred to as "the Termination Date").

3. Acknowledgment of Termination

The Employee acknowledges and agrees that their employment with the Employer will cease on the Termination Date, and that all rights, benefits, and obligations arising from the employment contract between the parties, save for those specifically stipulated in this Agreement, will cease on that date.

4. Final Remuneration and Benefits

On or before the Termination Date, the Employer shall pay to the Employee:

(a) Any outstanding salary owed up to the Termination Date.

(b) Pro-rata leave pay for any accrued but unused leave days as at the Termination Date, calculated in accordance with the Employer's leave policy and applicable labour laws.

(c) Any other payments or benefits due to the Employee in terms of their employment contract or applicable legislation, including but not limited to, {{other_payments_benefits_description}}.

The Employee acknowledges that, save for the payments and benefits expressly stated in this Clause 4, no further remuneration, benefits, or compensation will be due or payable by the Employer to the Employee upon termination of employment.

5. Return of Company Property

The Employee agrees to return all company property, including but not limited to, keys, access cards, laptops, mobile phones, documents, and any other equipment or data belonging to the Employer, on or before the Termination Date. The Employee shall ensure that all such property is returned in good working order, reasonable wear and tear excepted.

6. Confidentiality

The Employee acknowledges that during the course of their employment, they have had access to confidential and proprietary information belonging to the Employer. The Employee agrees to continue to maintain the confidentiality of all such information indefinitely after the Termination Date and not to disclose or use any such information for any purpose other than for the benefit of the Employer, without the prior written consent of the Employer. This obligation shall survive the termination of employment.

7. Full and Final Settlement

The Employee accepts the terms of this Agreement as a full and final settlement of all claims, demands, actions, and causes of action of whatsoever nature that the Employee may have or acquire against the Employer, its directors, employees, agents, or affiliates, arising from or in connection with the Employee's employment or the termination thereof.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of {{country}}.

9. Entire Agreement

This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior discussions, negotiations, and agreements, whether oral or written, between the parties.
