POST-NUPTIAL AGREEMENT

THIS POST-NUPTIAL AGREEMENT (the “Agreement”) is made and entered into this {{day}} day of {{month}}, {{year}}, by and between {{parties_name_1}}, of {{parties_address_1}} (hereinafter referred to as “Party A”), and {{parties_name_2}}, of {{parties_address_2}} (hereinafter referred to as “Party B”).

Party A and Party B are sometimes collectively referred to herein as the “Parties” and individually as a “Party.”

RECITALS

WHEREAS, Party A and Party B were lawfully married on {{date_of_marriage}} in {{place_of_marriage}}.

WHEREAS, the Parties desire to define and formalize their respective rights and responsibilities regarding their separate property and marital property, both presently owned and hereafter acquired, and to establish a clear understanding of their financial arrangements during their marriage and in the event of separation, divorce, or death.

WHEREAS, the Parties each acknowledge that they have been advised to seek independent legal counsel regarding this Agreement, and have either done so or have knowingly and voluntarily waived their right to do so.

SEPARATE PROPERTY

The Parties hereby declare that the assets and liabilities listed in Schedule A, attached hereto and incorporated by reference, shall be considered the separate property of Party A.

The Parties hereby declare that the assets and liabilities listed in Schedule B, attached hereto and incorporated by reference, shall be considered the separate property of Party B.

Each Party shall have sole ownership, control, and enjoyment of their respective separate property, and the other Party shall have no claim or interest in such separate property, now or in the future, regardless of how such property appreciates or depreciates in value during the marriage.

MARITAL PROPERTY

All property, whether real, personal, or mixed, acquired by either Party or jointly by the Parties from the date of their marriage until the execution of this Agreement, that is not designated as separate property in Schedule A or Schedule B, shall be considered marital property.

All property acquired by either Party or jointly by the Parties after the date of execution of this Agreement shall be considered marital property unless otherwise specifically designated as separate property in a written agreement signed by both Parties.

In the event of separation or divorce, the marital property shall be divided equally between the Parties, unless otherwise agreed to in writing by both Parties.

DEBTS AND LIABILITIES

Each Party shall be solely responsible for their separate debts and liabilities as listed in Schedule A and Schedule B, respectively, and shall indemnify and hold the other Party harmless from any claims or actions arising from such separate debts.

All debts and liabilities incurred jointly by the Parties during the marriage, or incurred by either Party for the benefit of the marriage, shall be considered marital debts and shall be equally divided between the Parties in the event of separation or divorce.

MAINTENANCE/ALIMONY WAIVER

Each Party hereby waives any and all rights to receive spousal maintenance, alimony, or support from the other Party, both now and in the future, regardless of the cause of separation or divorce. This waiver is made knowingly, voluntarily, and with full understanding of its consequences.

DISCLOSURE OF ASSETS AND LIABILITIES

Each Party acknowledges that they have made a full and complete disclosure to the other Party of all their assets and liabilities as of the date of this Agreement, and that they have entered into this Agreement with full knowledge of the financial condition of the other Party.

GOVERNING LAW

This Agreement shall be construed and governed in accordance with the laws of {{country}}.

ENTIRE AGREEMENT

This Agreement constitutes the entire understanding and agreement between the Parties with respect to the subject matter hereof and supersedes all prior discussions, negotiations, and agreements, whether oral or written.
