Shop Tenancy Agreement

This Shop Tenancy Agreement (hereinafter referred to as the 'Agreement') is made and entered into on this {{day}} day of {{month}}, {{year}}, by and between:

Landlord: {{landlord_name}}, residing at/with registered office at {{landlord_address}} (hereinafter referred to as the 'Landlord', which expression shall where the context so admits include his/her/its heirs, executors, administrators, successors-in-title and assigns);

AND

Tenant: {{tenant_name}}, residing at/with registered office at {{tenant_address}} (hereinafter referred to as the 'Tenant', which expression shall where the context so admits include his/her/its heirs, executors, administrators, successors-in-title and assigns).

1. Demised Premises

The Landlord hereby agrees to let and the Tenant hereby agrees to take on tenancy the shop premises located at {{shop_address}} (hereinafter referred to as the 'Demised Premises'), more particularly described as {{shop_description}}.

2. Term of Tenancy

The tenancy shall be for a fixed term of {{term_years}} ({{term_years_words}}) years, commencing on {{commencement_date}} and expiring on {{expiry_date}}.

3. Rent

The Tenant shall pay to the Landlord a monthly rent of {{currency}} {{rent_amount}} ({{rent_amount_words}}) payable in advance on or before the {{rent_due_day}} day of each calendar month. The first payment of rent shall be made on the signing of this Agreement.

4. Security Deposit

The Tenant shall pay to the Landlord a security deposit of {{currency}} {{deposit_amount}} ({{deposit_amount_words}}) on the signing of this Agreement. This deposit shall be held by the Landlord as security for the due performance and observance by the Tenant of all the covenants and conditions of this Agreement. The deposit shall be refunded to the Tenant without interest upon the expiration or earlier termination of the tenancy, subject to any deductions for damages or unpaid rent.

5. Use of Premises

The Tenant shall use the Demised Premises solely for the purpose of {{permitted_use}} and for no other purpose whatsoever without the prior written consent of the Landlord.

6. Tenant's Covenants

The Tenant agrees to:

a) Keep the Demised Premises in good and tenantable repair and condition.

b) Pay all utility charges including electricity, water, and refuse collection.

c) Not to make any structural alterations or additions to the Demised Premises without the prior written consent of the Landlord.

d) Permit the Landlord or his agents to enter and view the condition of the Demised Premises at reasonable times upon prior notice.

e) Not to assign, sublet, or part with possession of the Demised Premises or any part thereof without the prior written consent of the Landlord.

7. Landlord's Covenants

The Landlord agrees to:

a) Ensure the Tenant has quiet enjoyment of the Demised Premises without interruption.

b) Pay all rates, taxes, and other outgoings in respect of the Demised Premises, except those expressly made payable by the Tenant.

c) Keep the exterior and common parts of the building in good repair and condition.

8. Termination

This Agreement may be terminated by either party giving {{notice_period}} ({{notice_period_words}}) months' prior written notice to the other. The Landlord may terminate this Agreement immediately in the event of a breach of any of the Tenant's covenants herein.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of {{country}}.
