AGREEMENT FOR PERMISSION TO SUBLET

This Agreement is made and entered into on this {{day}} day of {{month}}, {{year}}.

BETWEEN:

{{landlord_name}} of {{landlord_address}} (hereinafter referred to as the “Landlord”)

AND

{{tenant_name}} of {{tenant_address}} (hereinafter referred to as the “Tenant”)

RECITALS

WHEREAS, the Landlord and Tenant entered into a Lease Agreement dated {{original_lease_date}} for the property located at {{property_address}} (hereinafter referred to as the “Premises”);

WHEREAS, the Tenant desires to sublet a portion/the entirety of the Premises to a subtenant;

WHEREAS, the Landlord, subject to the terms and conditions set forth herein, is willing to grant permission for such subletting.

GRANT OF PERMISSION

The Landlord hereby grants permission to the Tenant to sublet the Premises, or a portion thereof, located at {{sublet_address}} (hereinafter referred to as the “Sublet Premises”) to {{subtenant_name}} of {{subtenant_address}} (hereinafter referred to as the “Subtenant”) for a period commencing on {{sublet_start_date}} and terminating on {{sublet_end_date}}.

TERMS AND CONDITIONS OF SUBLETTING

The Tenant shall remain fully responsible and liable for all obligations, terms, and conditions of the original Lease Agreement with the Landlord, notwithstanding this subletting.

The Subtenant shall be bound by all the terms and conditions of the original Lease Agreement between the Landlord and the Tenant, a copy of which is attached hereto as Annexure A.

The Tenant shall provide the Landlord with a copy of the Sublease Agreement between the Tenant and the Subtenant within {{days_to_provide_sublease}} days of its execution.

The Tenant shall not assign, transfer, or further sublet the Sublet Premises without the prior written consent of the Landlord.

RENT AND UTILITIES

The Tenant shall be solely responsible for the collection of rent from the Subtenant and for ensuring timely payment of rent to the Landlord as per the original Lease Agreement.

All utility bills and other charges related to the Premises shall remain the responsibility of the Tenant, unless otherwise agreed upon in writing between the Landlord and Tenant.

INDEMNITY

The Tenant hereby agrees to indemnify and hold harmless the Landlord from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with the subletting of the Premises, including but not limited to any breach by the Subtenant of the terms of this Agreement or the original Lease Agreement.

INSURANCE

The Tenant shall ensure that adequate insurance coverage remains in place for the Premises during the period of subletting, as required by the original Lease Agreement.

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of {{country_name}}.

ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the Landlord and the Tenant concerning the permission to sublet and supersedes all prior agreements, understandings, negotiations, and discussions, whether oral or written.
