CO-HABITATION AGREEMENT
This Co-habitation Agreement (hereinafter referred to as the “Agreement”) is made and entered into on this {{day}} day of {{month}}, {{year}}, by and between:
{{Partner_1_Full_Name}} (Identity Number: {{Partner_1_ID_Number}}) of {{Partner_1_Address}} (hereinafter referred to as “Partner 1”); and
{{Partner_2_Full_Name}} (Identity Number: {{Partner_2_ID_Number}}) of {{Partner_2_Address}} (hereinafter referred to as “Partner 2”).
Partner 1 and Partner 2 are collectively referred to as “the Parties”.
RECITALS
WHEREAS, the Parties intend to co-habitate at {{Property_Address}} (hereinafter referred to as the “Shared Residence”);
AND WHEREAS, the Parties wish to define their respective rights and obligations concerning their finances, property, and other matters arising from their cohabitation;
AND WHEREAS, the Parties acknowledge that this Agreement is entered into freely and voluntarily, with full understanding of its terms and conditions, and with the benefit of independent legal advice.
INDIVIDUAL PROPERTY
Each Party shall retain separate ownership and control over all property owned solely by them prior to the commencement of this Agreement, including but not limited to, real estate, vehicles, bank accounts, investments, and personal belongings.
Any property acquired by either Party individually during the cohabitation period, from their separate funds, shall remain the sole property of that Party.
JOINT PROPERTY
Any property acquired jointly by the Parties during the cohabitation period, with funds contributed by both Parties, shall be considered joint property and owned by them in equal shares, or in such proportions as agreed upon in writing at the time of acquisition.
Details of current joint property are listed in Schedule A attached hereto.
In the event of separation, joint property shall be divided equally, or as otherwise agreed upon in writing.
DEBTS AND LIABILITIES
Each Party shall be solely responsible for their individual debts and liabilities incurred prior to or during the cohabitation period, unless otherwise agreed upon in writing.
Joint debts incurred by mutual agreement shall be the responsibility of both Parties, in equal shares, or in such proportions as agreed upon in writing.
TERMINATION OF AGREEMENT
This Agreement may be terminated by either Party by providing {{Notice_Period}} days’ written notice to the other Party.
In the event of termination, the Parties shall cooperate in good faith to divide joint property and settle shared debts in accordance with the terms of this Agreement.
Upon termination, property and financial matters shall be resolved within {{Resolution_Period}} days.
GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of {{Country_Name}}.
FULL AND FINAL AGREEMENT
This Agreement constitutes the entire agreement between the Parties with respect to the subject matter hereof and supersedes all prior discussions, negotiations, and agreements, whether oral or written.
No amendment, modification, or waiver of any provision of this Agreement shall be effective unless made in writing and signed by both Parties.
