Agreement Reference

Lease Agreement dated {{original_lease_start_date}} between {{landlord_name}} (Landlord) and {{tenant_name}} (Tenant) for the property located at {{property_address}} (the "Premises").

Mutual Cancellation of Lease

This Mutual Cancellation of Lease Agreement (the "Agreement") is made and entered into on this {{cancellation_date}} by and between:

{{landlord_name}}, with an address at {{landlord_address}} (hereinafter referred to as "Landlord"), and

{{tenant_name}}, with an address at {{tenant_address}} (hereinafter referred to as "Tenant").

WHEREAS, Landlord and Tenant entered into a Lease Agreement for the Premises on {{original_lease_start_date}} (the "Original Lease"); and

WHEREAS, both Landlord and Tenant mutually desire to terminate the Original Lease Agreement prior to its original expiration date of {{original_lease_end_date}}.

Terms of Cancellation

1. **Termination Date:** The Original Lease Agreement shall be terminated effective {{effective_termination_date}} (the "Termination Date"). On or before the Termination Date, Tenant shall vacate the Premises and return all keys and access devices to the Landlord.

2. **Rent and Utilities:** Tenant shall be responsible for all rent, utilities, and other charges as stipulated in the Original Lease up to and including the Termination Date. Any prepaid rent for periods after the Termination Date shall be refunded to the Tenant within {{refund_days}} days of the Termination Date, less any outstanding amounts owed to the Landlord.

3. **Security Deposit:** The security deposit of {{security_deposit_amount}} paid by the Tenant shall be returned to the Tenant within {{security_deposit_return_days}} days after the Termination Date, subject to any deductions for damages beyond normal wear and tear, unpaid rent, or other legitimate charges as provided in the Original Lease and applicable law. A detailed statement of any deductions will be provided to the Tenant.

4. **Condition of Premises:** Tenant agrees to surrender the Premises in broom-clean condition and good repair, ordinary wear and tear excepted, prior to the Termination Date. Landlord reserves the right to inspect the Premises upon vacation by the Tenant.

5. **Release of Liability:** Upon the full and timely performance of the terms of this Agreement, Landlord and Tenant hereby release and discharge each other from any and all further obligations, claims, demands, and liabilities arising from the Original Lease Agreement, except for those obligations that expressly survive the termination of the Original Lease or this Agreement.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction of {{jurisdiction}}.

Entire Agreement

This Agreement constitutes the entire understanding between the Landlord and Tenant regarding the mutual cancellation of the Original Lease and supersedes all prior discussions, negotiations, and agreements, whether oral or written.

Amendments

Any amendments or modifications to this Agreement must be in writing and signed by both the Landlord and the Tenant.
