Parties

This Photography Contract ("Agreement") is made and entered into as of {{date_of_agreement}}

BETWEEN:

{{photographer_name}} of {{photographer_address}} (hereinafter referred to as "Photographer")

AND

{{client_name}} of {{client_address}} (hereinafter referred to as "Client")

Services

The Client hereby engages the Photographer to provide photography services as described in Schedule A (hereinafter referred to as "Services").

The Photographer agrees to provide the Services with due care, skill, and diligence, and in accordance with the specifications agreed upon by both parties.

Fees and Payment

The Client agrees to pay the Photographer a total fee of {{total_fee}} for the Services.

An upfront deposit of {{deposit_amount}} is due upon the signing of this Agreement.

The remaining balance of {{balance_amount}} shall be due on or before {{payment_due_date}}.

Payment can be made via {{payment_method}}.

Deliverables

The Photographer agrees to deliver the following to the Client:

{{number_of_photos}} high-resolution digital images in {{file_format}} format.

{{number_of_prints}} prints of selected images, size {{print_size}}.

Delivery shall be made by {{delivery_date}} via {{delivery_method}}.

Copyright and Usage Rights

The Photographer retains the copyright to all images produced.

The Client is granted a non-exclusive license to use the images for {{client_usage_purpose}}.

Any other use or commercial exploitation of the images by the Client requires prior written consent from the Photographer and may incur additional fees.

The Photographer reserves the right to use the images for promotional and portfolio purposes unless otherwise agreed in writing.

Cancellation and Rescheduling

If the Client cancels this Agreement less than {{cancellation_notice_days}} days before the scheduled date, the deposit will be forfeited.

If the Photographer is unable to perform the Services due to unforeseen circumstances, a full refund will be provided, or a mutually agreeable reschedule will be arranged.

Rescheduling by the Client is subject to the Photographer's availability and may incur additional charges if rescheduled less than {{reschedule_notice_days}} days in advance.

Limitation of Liability

The Photographer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with this Agreement.

The Photographer's total liability under this Agreement shall not exceed the total fees paid by the Client.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of {{jurisdiction}}.

Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements and understandings, whether written or oral, relating to the subject matter of this Agreement.
