PROPERTY MANAGEMENT AGREEMENT
This Property Management Agreement ("Agreement") is made and entered into on this {{day}} day of {{month}}, {{year}}, by and between:
{{owner_name}} (hereinafter referred to as "Owner"), residing at {{owner_address}}.
AND
{{manager_company_name}} (hereinafter referred to as "Manager"), a company duly incorporated under the laws of {{country}}, with its principal place of business at {{manager_address}}.
1. APPOINTMENT OF MANAGER
The Owner hereby appoints the Manager as the sole and exclusive agent to manage the property located at {{property_address}} (hereinafter referred to as "the Property"), and the Manager hereby accepts such appointment.
2. DUTIES AND RESPONSIBILITIES OF THE MANAGER
The Manager shall diligently and faithfully perform the following duties:
a. **Tenant Management:** Advertise the Property, screen prospective tenants, negotiate and execute lease agreements, collect rent, handle tenant inquiries and complaints, and initiate eviction proceedings when necessary.
b. **Property Maintenance:** Oversee the ordinary repair and maintenance of the Property, arrange for necessary services such as cleaning, landscaping, and waste removal, and conduct regular inspections.
c. **Financial Management:** Collect all rents and other income, pay all authorized expenses related to the Property, maintain accurate financial records, and provide the Owner with monthly statements of account.
d. **Legal Compliance:** Ensure the Property complies with all applicable local, national, and international laws, codes, and regulations.
3. OWNER'S COVENANTS AND OBLIGATIONS
The Owner covenants and agrees to:
a. Provide the Manager with all necessary documents and information pertaining to the Property.
b. Grant the Manager full authority to execute lease agreements and other related documents on behalf of the Owner.
c. Provide funds for the payment of expenses related to the Property as and when required.
d. Indemnify and hold the Manager harmless against all claims, liabilities, losses, damages, and expenses arising from the management of the Property, except in cases of the Manager's gross negligence or willful misconduct.
4. REMUNERATION AND EXPENSES
The Owner shall pay the Manager a management fee of {{management_fee_percentage}}% of the gross rents collected each month. The Manager is also entitled to reimbursement for all reasonable and necessary expenses incurred in the performance of its duties, provided such expenses are approved by the Owner in advance for amounts exceeding {{expenditure_limit}} {{currency}}.
5. TERM AND TERMINATION
This Agreement shall commence on {{start_date}} and continue for a period of {{term_duration}} (e.g., one year). Thereafter, it shall automatically renew for successive periods of {{renewal_duration}} unless either party gives written notice of termination at least {{notice_period}} days prior to the end of the current term. Upon termination of this Agreement, the Manager shall provide the Owner with a final accounting and transfer all funds and documents pertaining to the Property.
6. INDEMNIFICATION
The Owner agrees to indemnify, defend, and hold harmless the Manager from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) that the Manager may incur as a result of the performance of its duties under this Agreement, except for those arising from the Manager's gross negligence or willful misconduct.
7. GOVERNING LAW AND DISPUTE RESOLUTION
This Agreement shall be governed by and construed in accordance with the laws of {{country}}. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of {{country}}.
8. ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements, understandings, and negotiations, whether written or oral, relating to the subject matter hereof.
