Sales Commission Plan Agreement
This Sales Commission Plan Agreement (the 'Agreement') is made effective as of {{effective_date}} (the 'Effective Date') by and between {{company_name}} (the 'Company') and {{employee_name}} (the 'Employee').
The purpose of this Agreement is to define the terms and conditions under which the Employee will be compensated through sales commissions.
Commission Eligibility and Structure
The Employee is eligible for commission payments based on achieved sales targets as outlined in this Agreement.
Commission will be calculated as {{commission_percentage}}% of the net revenue generated from new sales closed by the Employee, excluding any returns, discounts, or uncollectible accounts.

Sales Targets and Quotas

Clawback Provisions
In the event of a customer refund, cancellation, or uncollectible invoice related to a sale for which commission has already been paid, the Company reserves the right to claw back the corresponding commission amount.

Termination of Employment
Upon termination of employment for any reason, the Employee will be eligible for commissions on sales closed and fully paid up to the effective date of termination.
No commissions will be paid for sales in progress or not yet fully paid at the time of termination.
The final commission payment will be included in the Employee's final paycheck or paid within {{days_for_final_payment}} days of termination.
Dispute Resolution
Any disputes regarding commission calculations or payments shall be submitted in writing to the {{department_for_disputes}} Department within {{days_for_dispute_submission}} days of the commission statement issuance.
The Company and Employee agree to attempt to resolve any disputes amicably through good faith negotiation.
General Provisions
This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior agreements, understandings, negotiations, and discussions, whether oral or written, of the parties.
This Agreement shall be governed by and construed in accordance with the laws of {{country_laws}}.
Any amendments to this Agreement must be made in writing and signed by both parties.
