EQUIPMENT USE AGREEMENT

This Equipment Use Agreement (the 'Agreement') is made and entered into as of {{date_of_agreement}}, by and between {{company_name}}, with its principal place of business at {{company_address}} (the 'Lender'), and {{user_name}}, with an address at {{user_address}} (the 'User').

1. EQUIPMENT

The Lender hereby agrees to permit the User to use the following equipment (the 'Equipment'):

c. Serial Number: {{serial_number}}

d. Asset Tag Number: {{asset_tag_number}}

e. Condition: {{equipment_condition}}

2. TERM OF AGREEMENT

This Agreement shall commence on {{start_date}} and shall continue in full force and effect until {{end_date}}, unless terminated earlier as provided herein. The User shall return the Equipment to the Lender on or before the end date.

3. PURPOSE OF USE

The User shall use the Equipment solely for the purpose of {{purpose_of_use}} and shall not use it for any illegal or unauthorized purpose.

4. LOCATION OF USE

The Equipment shall be kept and used at {{location_of_use}} and shall not be removed from this location without the prior written consent of the Lender.

5. MAINTENANCE AND REPAIR

The User shall be responsible for the proper care and maintenance of the Equipment during the Term of this Agreement and shall return the Equipment to the Lender in the same condition as received, reasonable wear and tear excepted. The User shall be responsible for any damages to the Equipment resulting from misuse, negligence, or unauthorized repairs.

6. INSURANCE

The User shall be responsible for insuring the Equipment against all risks of loss or damage during the term of this Agreement, or the Lender may require proof of such insurance. The Lender shall be named as an additional insured on any such policy.

7. INDEMNIFICATION

The User agrees to indemnify, defend, and hold harmless the Lender from and against any and all claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising out of or in connection with the User's use of the Equipment.

8. RETURN OF EQUIPMENT

Upon the expiration or earlier termination of this Agreement, the User shall return the Equipment to the Lender at {{return_location}} in good working order and condition, reasonable wear and tear excepted.

9. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of South Africa.

10. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements and understandings, whether written or oral.
