Time Sharing Agreement
RECITALS
WHEREAS, the Parties desire to enter into an agreement for the shared use and enjoyment of the Asset.
WHEREAS, the Parties agree to abide by the terms and conditions set forth herein for the orderly and equitable division of usage time.
DEFINITIONS
"Asset" refers to the property or object subject to this Time Sharing Agreement, specifically: {{asset_description}}.
"Parties" refers to {{party_1_name}} and {{party_2_name}} (and any additional parties as listed in Schedule A).
"Usage Period" refers to the specific periods allocated to each Party for the exclusive use of the Asset as detailed in Schedule B.
GRANT OF USAGE RIGHTS
Each Party is hereby granted the right to use the Asset during their designated Usage Periods, subject to the terms and conditions of this Agreement.
Usage rights are non-transferable unless explicitly agreed upon in writing by all Parties.
SCHEDULING AND ALLOCATION
The allocation of Usage Periods shall be determined in accordance with Schedule B attached hereto.
Any changes to the Usage Period schedule must be agreed upon by all Parties in writing at least {{notice_period}} days in advance.
MAINTENANCE AND UPKEEP
Each Party shall be responsible for the proper care and maintenance of the Asset during their respective Usage Period.
Costs associated with routine maintenance, repairs, and utilities shall be shared equally among the Parties, or as otherwise specified in Schedule C.
Any damage to the Asset beyond normal wear and tear caused by a Party shall be the sole financial responsibility of that Party.
INSURANCE
The Parties shall jointly maintain comprehensive insurance coverage for the Asset, including but not limited to, property damage and liability insurance.
Proof of insurance shall be provided to all Parties annually.
EXPENSES AND CONTRIBUTIONS
All shared expenses related to the Asset, including insurance premiums, property taxes, and major repairs, shall be paid by the Parties in equal shares, unless otherwise stipulated in Schedule C.
Parties shall contribute their share of expenses within {{payment_due_days}} days of receiving an invoice.
DEFAULT AND TERMINATION
In the event of a material breach of this Agreement by any Party, the non-breaching Party(ies) may issue a written notice of default.
If the default is not remedied within {{cure_period_days}} days of the notice, the non-breaching Party(ies) may terminate this Agreement with respect to the defaulting Party, subject to any applicable legal remedies.
This Agreement may be terminated by mutual written consent of all Parties.
GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of {{country_name}}.
ENTIRE AGREEMENT
This Agreement constitutes the entire understanding and agreement between the Parties with respect to the subject matter hereof, and supersedes all prior agreements, understandings, and representations, whether oral or written.
