Date of Agreement
This Airbnb Arbitrage Agreement (hereinafter referred to as "Agreement") is made and entered into on this {{day}} day of {{month}}, {{year}} (hereinafter referred to as "Effective Date").
Parties to the Agreement
This Agreement is between:
Property Owner: {{owner_name}} of {{owner_address}} (hereinafter referred to as "Owner")
AND
Arbitrage Operator: {{operator_name}} of {{operator_address}} (hereinafter referred to as "Operator")
Property Details
The Owner hereby grants the Operator the right to manage and rent out the property located at {{property_address}} (hereinafter referred to as "the Property") on short-term rental platforms such as Airbnb.
Term of Agreement
This Agreement shall commence on the Effective Date and shall continue for a period of {{term_length}} (e.g., twelve months), renewable upon mutual written consent of both parties. Either party may terminate this Agreement by providing {{notice_period}} days' written notice to the other party.
Operator's Responsibilities
The Operator shall be responsible for:
a. Listing the Property on Airbnb and other agreed-upon short-term rental platforms.
b. Managing all guest communications, bookings, and inquiries.
c. Arranging for cleaning and maintenance of the Property after each guest stay, ensuring it is kept in excellent condition.
d. Setting rental prices, subject to Owner's approval for major adjustments, to maximize occupancy and revenue.
e. Handling all check-ins and check-outs.
f. Providing basic amenities for guests (e.g., toiletries, linens, towels).
g. Ensuring compliance with all local regulations and laws pertaining to short-term rentals.
Owner's Responsibilities
The Owner shall be responsible for:
a. Ensuring the Property is in good habitable condition prior to the commencement of this Agreement.
b. Covering the costs of major repairs and structural maintenance as necessary.
c. Providing the Operator with access to the Property and necessary utilities (e.g., water, electricity, internet).
d. Maintaining appropriate landlord insurance for the Property.
e. Granting the Operator the necessary authority to act on their behalf concerning short-term rentals.
Financial Arrangements
a. The Operator shall pay the Owner a fixed monthly rental amount of {{monthly_rent_amount}} on the {{payment_day}} of each month.
b. Alternatively, the Operator shall pay the Owner {{owner_percentage}}% of the net rental income (gross revenue less platform fees and cleaning costs) generated from the Property, payable on the {{payment_day}} of each month.
c. The Operator shall provide a detailed monthly statement of income and expenses by the {{reporting_day}} of each month.
d. A security deposit of {{security_deposit_amount}} shall be paid by the Operator to the Owner upon signing of this Agreement, to be held against any damages or unpaid fees.
Insurance and Liability
The Operator shall maintain public liability insurance covering their operations on the Property. The Owner shall maintain adequate property insurance. Each party indemnifies the other against any claims, losses, or damages arising from their own negligence or breach of this Agreement.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of {{country_name}}.
Dispute Resolution
