Mutual Cancellation of Lease
Agreement to Terminate Lease
This Mutual Cancellation of Lease Agreement ('Agreement') is made and entered into on this {{day}} day of {{month}}, {{year}}, by and between:
Landlord: {{landlord_name}}, residing at/with principal place of business at {{landlord_address}} (hereinafter referred to as 'Landlord')
and
Tenant: {{tenant_name}}, residing at {{tenant_address}} (hereinafter referred to as 'Tenant')
collectively referred to as the 'Parties'.
Reference to Original Lease
The Parties hereto acknowledge that they entered into a Lease Agreement dated {{original_lease_start_date}} for the property located at {{property_address}} (hereinafter referred to as the 'Premises'). The original lease term was for a period of {{lease_term_length}} starting from {{original_lease_start_date}} and ending on {{original_lease_end_date}}.
Mutual Agreement to Terminate
Notwithstanding the provisions of the original Lease Agreement, the Parties hereby mutually agree to terminate the said Lease Agreement effective {{termination_date}} (hereinafter referred to as the 'Termination Date').
Tenant's Obligations Upon Termination
Tenant agrees to vacate the Premises, remove all personal property belonging to Tenant, and return possession of the Premises to Landlord in good, broom-clean condition, reasonable wear and tear excepted, on or before the Termination Date.
Tenant further agrees to pay all rent, utilities, and other charges due under the original Lease Agreement up to and including the Termination Date. Any outstanding balances shall be settled on or before the Termination Date.
Return of Security Deposit
Landlord agrees to return the security deposit of {{security_deposit_amount}} ({{security_deposit_currency}}) to Tenant, less any lawful deductions for damages beyond reasonable wear and tear or unpaid rent/charges, within {{days_for_security_deposit_return}} days after the Tenant has vacated the Premises and returned possession to the Landlord in accordance with the terms of this Agreement and the original Lease Agreement.
Release and Discharge
Upon the full and timely performance by both Parties of their respective obligations under this Agreement, the Parties shall be released and discharged from all further obligations and liabilities arising from or related to the original Lease Agreement, with the exception of any obligations or liabilities that, by their nature, survive the termination of the Lease Agreement.
Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of {{country/state/province}}.
Entire Agreement
This Agreement constitutes the entire agreement between the Parties with respect to the early termination of the Lease Agreement and supersedes all prior discussions, negotiations, and agreements, whether oral or written.
