Sales Commission Plan
Sales Commission Plan
1. Purpose
The purpose of this Sales Commission Plan (the "Plan") is to define the terms under which sales employees of {{company_name}} will be eligible for and receive commission payments for sales activities. This Plan aims to incentivize and reward high-performance sales professionals.
2. Eligibility
This Plan applies to all sales employees of {{company_name}} who are directly involved in revenue-generating activities, as defined by their job description. Eligibility for commission commences on {{start_date_of_employment}}.
3. Commission Structure
Commission will be calculated based on {{gross_revenue_or_net_profit}} generated from sales closed by the employee, or a combination of both. The commission rate is {{commission_rate}}% of the {{basis_for_commission}} achieved. Specific targets and tiers are outlined below:
Tier 1: Up to {{tier1_sales_target}} - {{tier1_commission_rate}}%
Tier 2: From {{tier1_sales_target}} to {{tier2_sales_target}} - {{tier2_commission_rate}}%
Tier 3: Above {{tier2_sales_target}} - {{tier3_commission_rate}}%
All sales figures will be verified against {{company_name}} financial records and CRM system.
4. Commissionable Sales
Commissionable sales include all new business generated and successfully closed by the employee, as confirmed by signed contracts or purchase orders and receipt of payment. Non-commissionable sales include, but are not limited to, refunded sales, cancelled orders, and sales to internal departments.
5. Payment Cycle and Reporting
Commission payments will be calculated and paid on a {{monthly/quarterly}} basis on the last business day of the month following the close of the {{month/quarter}}. Employees will receive a detailed commission statement outlining their sales performance and earnings for the period. Payments will be made via {{payment_method}}.
6. Clawback Provisions
In the event of a customer refund, return, or cancellation of an order for which commission has already been paid, {{company_name}} reserves the right to deduct the unearned commission from future commission payments or, if no future payments are due, require repayment from the employee. This clawback will be applied within {{number_of_days}} days of the refund/cancellation.
7. Termination of Employment
In the event of termination of employment, commission will be paid on all eligible sales closed and paid for up to the date of termination. Any outstanding commission will be paid on the next scheduled commission payment date following termination. No commission will be paid for sales closed after the date of termination, regardless of when the sales process began.
8. Amendments to the Plan
{{company_name}} reserves the right to amend, modify, or terminate this Plan at any time, with {{notice_period}} days' written notice to affected employees. Any changes will be communicated in writing and will become effective on the date specified in the notice.
