COLLECTIVE BARGAINING AGREEMENT
This Collective Bargaining Agreement (hereinafter referred to as 'the Agreement') is made and entered into on this the {{day}} day of {{month}}, {{year}}, by and between:
{{company_name}}, a company duly incorporated and registered in accordance with the laws of {{country}}, with its principal place of business at {{company_address}} (hereinafter referred to as 'the Employer');
AND
{{union_name}}, a duly registered trade union with registration number {{union_registration_number}}, having its offices at {{union_address}} (hereinafter referred to as 'the Union').
WHEREAS, the Employer and the Union recognise the importance of maintaining a harmonious and productive working relationship.
WHEREAS, the Union is duly recognised as the sole and exclusive bargaining agent for all employees within the bargaining unit as defined herein.
NOW, THEREFORE, in consideration of the mutual covenants and promises herein contained, the parties hereto agree as follows:
SCOPE AND APPLICATION
This Agreement shall apply to all employees who fall within the bargaining unit, which is defined as: {{bargaining_unit_definition}}.
This Agreement supersedes all prior agreements, understandings, practices, and customs, whether written or oral, between the Employer and the Union, insofar as they conflict with the provisions of this Agreement.
This Agreement shall not detract from any existing statutory rights or benefits to which employees may be entitled.
TERMS AND CONDITIONS OF EMPLOYMENT
**4.1 Wages and Salaries:**
The minimum wage for employees within the bargaining unit shall be {{minimum_wage_amount}} per {{pay_period}}. A salary scale outlining various grades and their corresponding remuneration is attached hereto as Schedule A. Wage reviews shall be conducted annually, effective from {{annual_review_date}}.
**4.2 Working Hours:**
The standard working week shall consist of {{standard_working_hours}} hours, spread over {{number_of_days}} days. Overtime shall be paid at a rate of {{overtime_rate}} times the ordinary hourly rate for hours worked beyond the standard working week.
**4.3 Leave Entitlements:**
Employees shall be entitled to annual leave of {{annual_leave_days}} working days per annum, sick leave of {{sick_leave_days}} days in a {{sick_leave_cycle_years}}-year cycle, and family responsibility leave as per statutory requirements. Specific details regarding leave application procedures are outlined in the Employee Handbook.
**4.4 Benefits:**
The Employer shall provide the following benefits: {{list_of_benefits}}. Details of these benefits, including eligibility and contribution rates, are contained in Schedule B.
**4.5 Health and Safety:**
The Employer commits to providing a safe and healthy working environment in compliance with all relevant occupational health and safety legislation. The Employer and the Union shall cooperate in promoting health and safety awareness and adherence to safety protocols.
GRIEVANCE AND DISPUTE RESOLUTION PROCEDURE
Any grievance or dispute arising between an employee and the Employer, or between the Union and the Employer, concerning the interpretation or application of this Agreement, shall be resolved in accordance with the following procedure:
**5.1 Stage 1: Informal Discussion:** The aggrieved employee shall first attempt to resolve the matter informally with their immediate supervisor within {{days_for_informal_discussion}} working days of the incident or knowledge thereof.
**5.2 Stage 2: Formal Grievance:** If unresolved at Stage 1, the employee, assisted by a shop steward if desired, may submit a formal written grievance to the departmental manager within {{days_for_formal_grievance}} working days. The departmental manager shall respond in writing within {{days_for_departmental_response}} working days.
**5.3 Stage 3: Management Review:** If unresolved at Stage 2, the grievance may be referred to senior management for review within {{days_for_management_review}} working days. A meeting will be held involving the employee, Union representatives, and senior management to seek a resolution.
**5.4 Stage 4: External Mediation/Arbitration:** If no resolution is reached internally, either party may refer the dispute to {{external_dispute_resolution_body}} for mediation or arbitration, in accordance with its rules and procedures.
DISCIPLINARY CODE AND PROCEDURE
The Employer shall implement a fair and consistent Disciplinary Code and Procedure, aligned with applicable labour laws. The Disciplinary Code and Procedure, attached as Schedule C, outlines various offences and the corresponding disciplinary actions. Employees have the right to a fair hearing, representation, and appeal.
The Union shall be consulted prior to any significant amendments to the Disciplinary Code and Procedure.
RECOGNITION OF THE UNION
The Employer recognises {{union_name}} as the sole and exclusive bargaining agent for all employees falling within the defined bargaining unit.
The Employer undertakes to grant Union representatives reasonable access to the workplace for the purpose of consulting with members, provided such access does not unduly disrupt operations.
The Employer agrees to the deduction of union subscriptions from employees' wages, upon receipt of a written authorisation from the individual employee, and to remit such deductions to the Union within {{days_for_remittance}} days of deduction.
DURATION AND REVIEW OF AGREEMENT
This Agreement shall become effective on {{effective_date}} and shall remain in force for a period of {{agreement_duration_years}} year(s), ending on {{expiry_date}}.
Either party may, by giving {{notice_period_months}} months' written notice to the other party, request a review of this Agreement prior to its expiry. Negotiations for a new agreement shall commence within {{days_for_negotiation_commencement}} days of such notice.
AMENDMENTS AND WAIVERS
Any amendment or variation to this Agreement shall only be valid if reduced to writing and signed by authorised representatives of both the Employer and the Union.
No waiver by either party of any breach of any provision of this Agreement shall be deemed to be a waiver of any subsequent or continuing breach of the same or any other provision.
GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the labour laws of {{country_of_governing_law}}.
