Telecommuting Agreement
This Telecommuting Agreement ("Agreement") is entered into on this {{date}} day of {{month}}, {{year}}, by and between {{company_name}} (hereinafter referred to as "the Company"), located at {{company_address}}, and {{employee_name}} (hereinafter referred to as "the Employee"), residing at {{employee_address}}.
1. Purpose
The purpose of this Agreement is to establish the terms and conditions under which the Employee will perform work remotely from an approved alternative worksite, rather than the Company's primary business location. This Agreement aims to maintain productivity, ensure communication, and clarify expectations for both the Company and the Employee in a telecommuting arrangement.
2. Duration of Agreement
This Agreement shall commence on {{start_date}} and shall continue for an indefinite period, subject to review and termination as outlined in Section 10 of this Agreement. Either party may propose modifications to this Agreement at any time, which must be agreed upon in writing by both parties.
3. Approved Telecommuting Location
The Employee's approved telecommuting location is {{telecommuting_address}}. The Employee agrees to notify the Company immediately of any change in their telecommuting address. The Employee acknowledges that the Company reserves the right to approve or disapprove any proposed telecommuting location based on business needs, safety considerations, and legal compliance.
4. Work Hours and Availability

Due to the nature of their role, the Employee may be required to attend in-office meetings, training sessions, or other company events as determined by the Company with reasonable notice. Such instances will not be considered a breach of this telecommuting agreement.
5. Equipment and Workspace

The Employee is responsible for providing a safe and ergonomically sound workspace at the approved telecommuting location, along with reliable internet access and other necessary utilities. The Company is not responsible for expenses incurred by the Employee for maintaining their home office, including but not limited to electricity, internet, or phone services, unless otherwise specified in a separate written agreement.
6. Communication and Performance
The Employee agrees to maintain regular communication with their manager and team members through {{communication_channels}} (e.g., email, video conferencing, messaging apps). Performance expectations, deliverables, and deadlines will remain the same as if the Employee were working from the Company's office.
Performance reviews and feedback will be conducted in the same manner as for in-office employees. The Employee is expected to adhere to all Company policies and procedures, including those pertaining to data security, confidentiality, and professional conduct, regardless of their work location.
7. Confidentiality and Data Security
The Employee acknowledges and agrees that all Company information, data, and intellectual property remain the exclusive property of the Company. The Employee is strictly prohibited from sharing or disclosing any confidential Company information to unauthorized individuals, regardless of whether they are working remotely or in the office.
The Employee will take all necessary precautions to protect Company data and equipment from unauthorized access, loss, or damage. This includes, but is not limited to, using secure networks, password-protecting devices, and immediately reporting any security breaches or suspicious activities to {{IT_department_contact}}.
8. Insurance and Liability
The Employee acknowledges that the Company's liability for injuries sustained at the telecommuting location is limited and governed by applicable workers' compensation laws. The Employee is responsible for maintaining appropriate homeowner's or renter's insurance to cover their personal property and any potential liabilities arising from their telecommuting activities.
The Company will not be responsible for any damage or injury to the Employee's personal property that may occur at the telecommuting location.
9. Reimbursement of Expenses
The Company will reimburse the Employee for pre-approved, business-related expenses incurred while telecommuting, in accordance with the Company's expense reimbursement policy. The Employee must submit expense reports with supporting documentation to {{department_for_expense_submission}} by {{submission_deadline}}.
10. Termination of Agreement
This Agreement may be terminated by either party with {{notice_period}} days' written notice.
