Residential Service Agreement

This Residential Service Agreement (hereinafter referred to as the “Agreement”) is made and entered into on this {{date_of_agreement}} day of {{month_of_agreement}}, {{year_of_agreement}} (the “Effective Date”), by and between:

{{company_name}}, a company duly registered and existing under the laws of {{country}}, with its principal place of business located at {{company_address}} (hereinafter referred to as the “Service Provider”);

AND

{{client_name}}, an individual residing at {{client_address}} (hereinafter referred to as the “Client”).

The Service Provider and the Client are hereinafter individually referred to as “Party” and collectively as “Parties”.

1. Services to be Provided

1.1. The Service Provider shall perform the following services for the Client (hereinafter referred to as the “Services”):

1.2. The Services will be performed at the Client’s residence located at {{service_address}}.

2. Term of Agreement

2.1. This Agreement shall commence on the Effective Date and shall continue for a period of {{agreement_duration}} (e.g., months, years) until {{end_date}}, unless terminated earlier in accordance with the provisions of this Agreement.

2.2. This Agreement may be renewed upon mutual written consent of both Parties.

3. Payment Terms

3.1. The Client agrees to pay the Service Provider the amount of {{currency}} {{service_fee}} for the Services rendered.

3.2. Payment shall be made {{payment_frequency}} (e.g., weekly, monthly, upon completion) on or before {{due_date_of_payment}}.

3.3. In the event of late payment, the Client agrees to pay a late fee of {{currency}} {{late_fee_amount}} or {{late_fee_percentage}}% per month on the outstanding balance.

3.4. All prices exclude Value Added Tax (VAT) unless otherwise stated. VAT will be charged at the prevailing rate of {{VAT_rate}}%.

4. Client Obligations

4.1. The Client agrees to provide the Service Provider with reasonable access to the property to perform the Services.

4.2. The Client shall provide all necessary information, materials, and cooperation required by the Service Provider to effectively carry out the Services.

4.3. The Client shall ensure that the work area is safe and free from hazards for the Service Provider’s personnel.

5. Independent Contractor Status

5.1. The Service Provider is an independent contractor and not an employee of the Client. This Agreement does not create an employer-employee relationship, partnership, or joint venture between the Parties.

5.2. The Service Provider shall be solely responsible for all taxes, including income tax, unemployment insurance, and social security, related to the compensation received under this Agreement.

6. Confidentiality

6.1. Both Parties agree to keep confidential all non-public information obtained during the course of this Agreement.

6.2. This obligation of confidentiality shall survive the termination of this Agreement.

7. Limitation of Liability

7.1. The Service Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the Services provided under this Agreement.

7.2. The Service Provider’s total liability for any claim arising out of or relating to this Agreement shall not exceed the total amount paid by the Client to the Service Provider under this Agreement.

8. Termination

8.1. Either Party may terminate this Agreement by providing written notice of {{notice_period}} days to the other Party.

8.2. In the event of termination, the Client shall pay for all Services rendered up to the date of termination.

8.3. This Agreement may be terminated immediately by either Party upon a material breach of any terms or conditions herein by the other Party.

9. Governing Law and Dispute Resolution

9.1. This Agreement shall be governed by and construed in accordance with the laws of {{country_of_jurisdiction}}.

9.2. Any dispute or claim arising out of or in connection with this Agreement, including its existence, validity, or termination, shall be resolved through amicable negotiation. If negotiation fails, the dispute shall be submitted to mediation in {{city}} and, if mediation fails, then to arbitration in accordance with the rules of the Arbitration Foundation of Southern Africa (AFSA).

10. Entire Agreement

10.1. This Agreement constitutes the entire agreement between the Parties and supersedes all prior discussions, negotiations, and agreements, whether oral or written.

10.2. Any amendments to this Agreement must be in writing and signed by both Parties.
