AGREEMENT TO CANCEL LEASE
This Agreement to Cancel Lease (hereinafter referred to as the 'Agreement') is made and entered into on this {{date}} day of {{month}}, {{year}}, by and between:
Landlord: {{landlord_name}} of {{landlord_address}} (hereinafter referred to as the 'Landlord')
AND
Tenant: {{tenant_name}} of {{tenant_address}} (hereinafter referred to as the 'Tenant')
RECITALS
WHEREAS, Landlord and Tenant entered into a Lease Agreement dated {{original_lease_start_date}} for the property located at {{property_address}} (hereinafter referred to as the 'Premises'); and
WHEREAS, the original Lease Agreement was set to expire on {{original_lease_end_date}}; and
WHEREAS, Landlord and Tenant mutually desire to terminate the Lease Agreement prior to its scheduled expiration date, subject to the terms and conditions set forth herein.
AGREEMENT TO TERMINATE LEASE
The Landlord and Tenant hereby agree to terminate the Lease Agreement for the Premises, effective as of {{termination_date}} (hereinafter referred to as the 'Termination Date').
RETURN OF PREMISES
The Tenant agrees to vacate the Premises and return possession to the Landlord on or before the Termination Date. The Premises shall be surrendered in a clean and broom-swept condition, and in substantially the same condition as when the Tenant took possession, reasonable wear and tear excepted. The Tenant shall remove all personal property from the Premises on or before the Termination Date.
FINANCIAL SETTLEMENT
In consideration of the early termination of the Lease Agreement, the parties agree to the following financial settlement:
1. **Rent Payments:** The Tenant shall be responsible for all rent payments up to and including the Termination Date. Any prepaid rent for periods after the Termination Date shall be refunded to the Tenant within {{days_for_refund}} days of the Termination Date.
2. **Security Deposit:** The Landlord shall inspect the Premises after the Tenant vacates and shall return the security deposit of {{security_deposit_amount}} to the Tenant, less any deductions for damages beyond reasonable wear and tear or unpaid rent, within {{days_for_deposit_return}} days of the Termination Date, in accordance with the terms of the original Lease Agreement and applicable law.
3. **Early Termination Fee (if applicable):** The Tenant agrees to pay an early termination fee of {{early_termination_fee_amount}} to the Landlord on or before the Termination Date. This fee is separate from any damages or unpaid rent.
RELEASE OF LIABILITY
Upon the full execution of this Agreement and the satisfactory fulfillment of all terms and conditions contained herein, the Landlord and Tenant shall be released from all further obligations and liabilities arising from the original Lease Agreement, with the exception of any liabilities that expressly survive the termination of the Lease Agreement, such as those related to property damage or outstanding financial obligations.
GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of {{country_or_region}}.
ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the Landlord and Tenant concerning the termination of the Lease Agreement and supersedes all prior discussions, negotiations, and agreements, whether oral or written.
