Airbnb Arbitrage Agreement
This Airbnb Arbitrage Agreement ('Agreement') is made and entered into on this {{day}} day of {{month}}, {{year}}, by and between:
**{{owner_name}}** (hereinafter referred to as the 'Owner'), residing at {{owner_address}}, and
**{{operator_name}}** (hereinafter referred to as the 'Operator'), with business address at {{operator_address}}.
Collectively referred to as the 'Parties'.
1. Property Description and Purpose
The Owner hereby grants the Operator the exclusive right to operate the property located at {{property_address}} (hereinafter referred to as the 'Property') as a short-term rental, including but not limited to platforms such as Airbnb, Booking.com, and similar services.
The Property is described as: {{property_description}}.
2. Term of Agreement
This Agreement shall commence on {{start_date}} and continue for a period of {{agreement_term_months}} months, expiring on {{end_date}}.
This Agreement may be renewed upon mutual written consent of both Parties.
3. Operator's Responsibilities
The Operator shall be responsible for all aspects of managing the Property as a short-term rental, including but not limited to:
a. Creating and managing listings on relevant platforms.
b. Setting pricing, managing bookings, and communicating with guests.
c. Ensuring the Property is clean, well-maintained, and fully equipped for guests.
d. Handling guest check-ins and check-outs.
e. Providing customer support and addressing guest inquiries or issues.
f. Arranging for regular cleaning, maintenance, and minor repairs.
g. Obtaining and maintaining all necessary licenses, permits, and insurance for operating the short-term rental.
4. Owner's Responsibilities
The Owner shall be responsible for:
a. Ensuring the Property is in a habitable and safe condition prior to the commencement of the Agreement.
b. Providing all necessary access and utilities to the Operator.
c. Covering major structural repairs and maintenance beyond the scope of day-to-day operations.
d. Providing or financing the initial furnishing and setup of the Property as agreed upon by both Parties.
6. Insurance and Liability
The Operator shall obtain and maintain comprehensive public liability insurance with a minimum coverage of {{insurance_coverage_amount}} ZAR, naming the Owner as an additional insured party. Proof of insurance shall be provided to the Owner upon request.
The Owner shall maintain property insurance for the structure and its permanent fixtures.
Each Party shall indemnify and hold harmless the other Party from and against any and all claims, damages, liabilities, costs, and expenses arising from their respective acts or omissions in connection with this Agreement.
7. Termination of Agreement
This Agreement may be terminated by either Party upon {{notice_period_days}} days' written notice.
Either Party may terminate this Agreement immediately in the event of a material breach of any terms herein by the other Party, provided written notice of the breach is given and the breaching Party fails to remedy the breach within {{remedy_period_days}} days.
8. Governing Law and Dispute Resolution

Any dispute arising out of or in connection with this Agreement, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration in accordance with the rules of the Arbitration Foundation of Southern Africa (AFSA).
9. Entire Agreement
This Agreement constitutes the entire agreement between the Parties with respect to the subject matter hereof and supersedes all prior discussions, negotiations, and agreements, whether oral or written.
